We were lied to, cheated and now have to resolve issues created by Summerwinds, 1862 David Wally's Hot Springs Resort. Our salesman (John) said we could "trade in" our Wyndham Sedona timeshare week and we agreed to do that. We owned our Wyndham free and clear of any debt including maintenance fees at the time. John and his boss assured us we would not have to do anything. That has turned out to be a false. Now John says we should have gotten some paperwork to sign and send back in. Took him two months to do that. John tells me to contact a company that will take our timeshare. They want a fee to do this from us. 

Wyndham in the meantime is calling my wife and I every day to collect the 2015 maintenance fees. Wyndham says they have nothing showing the property has been traded in, we are still responsible. I contacted John over two months ago and the matter is still not resolved. Wyndham has now added late fees. Who is going to pay them?

I looked at all our paperwork with Summerwinds/1862,LLC and not only did our contract with them not show any trade in there is nothing anywhere except the word "Trade" on their preliminary worksheet. Come to find out we really did not need to trade in anything to get the price of $12,900.00 for their offer. It is all a sales ploy!

We bought this in March of 2014 and have made every payment (and $3,000 to principle) on our contract #80448. We have used no services from Summerwinds or 1862 David Wally's Hot Springs Resort what so ever! All we want now is all our money back and to cancel the contract we have with Summerwinds / 1862, LLC. Sure hope we do not have to go and hire an attorney to get them to do the right thing. They have failed to perform on their written agreement with us.
