The company in question here is 1lap2go.com, also known as comicverse (their billing name). The items they sell and their practices are described on the front page of their website:

We value every customer and take pride in offering superior packaging, quick shipment, and friendly five star customer service. Licensed comic super hero, cartoon,& horror apparel are also available. A selection of unique huggable DAKIN animal plush and adorable beanie babies product line-up included!

On 12/12/2002, I ordered two t-shirts from 1lap2go.com. On 12/14/2002, they contacted my via email stating that my order was being shipped with only one t-shirt because the other was out of stock. I replied on 12/16/2002 stating that I wanted both t-shirts, not just one (it was to be a father/son gift and wouldn't be the same if I couldn't get both) and that I was willing to wait for the second, but I didn't want to be billed for shipping on the second t-shirt since it was supposed to be with the original order. I received no reply. On 12/18/2002, I sent another email stating that I had not received a reply yet and asking how they were going to handle the situation. I received no reply. On 12/19/2002, I sent a more aggressive email stating that I would spread the word as to how bad their company was if I didn't receive a reply by the end of 12/20/2002 business day. I received a reply that day stating that I would not receive the other t-shirt, and that according to their policy they DO ship partial shipments in the case of out of stock items, and that any other email contact from me would be set to auto-delete. This is a misquote of their actual policy, which is as follows:

ITEM AVAILABILITY
All products are in stock (unless indicated or ordered in large quantity) and available for immediate shipment. If your order contains items in stock plus items out of stock which are available from the manufacturer, we will hold the order until it is complete. At your request, we can send a partial shipment but you will be charged shipping costs for each shipment. Please note this request in the comment section of your order form. Please allow 5 to 7 estimated business days to receive your order.

Here you can see it clearly states that an order will be held until completed unless requested by the customer. I made no such request. Obviously this is false advertising.
All I was asking for was to have the second t-shirt shipped with no shipping cost due to the fact that I was under the impression by their policy that my order would be held if incomplete. The customer service representative was very rude to me in his email reply as well.

This isn't as big of a deal as some companies scams out there, but if your worried about your items getting to you they way you ordered them, I wouldn't recommend using this company. Especially if you are buying christmas gifts.

I have not been harassing this company, in fact, I haven't been in contact with them since the BBB case filing at the time of the incident almost a year ago. The only reason I am dignifying this company's rebuttals with a response is because they are calling me a liar and accusing me of making false statements. So below you will see the complete email chain of events that occured between myself and this company, with personal information excluded/omitted to protect their 1st Amendment right (if they are going to drag me to court for telling you all this, I'm going to go for the right reasons).



Please keep in mind while reading the following emails that I was a little anxious to receive my shipment by Christmas, so the e-mails are not far apart in date. But in my defense I did order the shirts over two weeks in advance.



The following emails are in reverse chronological order, so you must begin at the bottom and read upwards. Below the emails is further explanation regarding them:

As you can see, my emails were placed on Auto-delete before the company made any attempts to resolve the issue.



You can also see in their last email to me that they tried to place the blame on me for the shipping problem, (quote from email - There was no where under comments that you stated not to send a partial shipment) for not specifying that I did not want a partial shipment when I placed the order intitially. This proves their first rebuttal written here to be untrue. They stated in their rebuttal that my quote of their policy is untrue, but if it is untrue, why in their email would they try to defend the position that I was supposed to state this under their comments section? If it was supposedly their policy all along to send partial shipments without notice' to the customer, then why wouldn't they have said that in their email? THEY CHANGED THEIR POLICY TO COVER UP THEIR TRACKS! As you can see in their ORIGINAL policy (which is in my first report above also), they state, At your request, we can send a partial shipment but you will be charged shipping costs for each shipment. It is their ORIGINAL policy that they are referring to that I believe caused them to word their email the way they did to try to dodge the free shipping. And that is all I was asking for from the beginning, was COMBINED SHIPPING. Not a free shirt as they claim. I was more than willing if not eager to pay for the second shirt that I ORIGINALLY ORDERED. This is where they were trying to RIP ME OFF, by potentially trying to charge me for shipping twice in order to complete my order.

So if this company wants to take me to court, I invite them to try, because I know that I have the supporting email documentation plus a complete copy of their ORIGINAL policy page on hard and soft copy to prove them wrong. I WILL NOT stand for attempts to intimidate me by threatening me with legal action.



To COMICVERSE / 1LAP2GO I extend this offer either take me to court and end up paying my lawyers' fees (when I counter-sue you for them) when you lose, or stop trying to tell the good people of this country that you are telling the truth and I'm lying, when you know the reverse is true. If you rebuttal this report update instead of taking me to court, then any consumer reading this will know that you are full of it. My recommendation to you is to drop your attempts to justify yourself in a situation where you are obviously wrong, and don't end up paying thousands of dollars in your own and my lawyer fees over a shirt and negative feedback. I have accepted the fact that last Christmas I couldn't give the gift I wanted to give to my family because of your company's inability to follow it's own policies, now it's your turn to accept the fact that you made a mistake and that it is well noted here. By the way, any further updates will only cause this report to be more easily found on search engines due to more keyword matching, so you're not doing yourself any favors by updating it anyway. My lawyers are awaiting your call!



To the consumer reading this, I leave this last assurance: If I am actually taken to court over this, I will document what happens as a result of the legal battle here at this website, so if you don't see anymore rebuttals by me, it is because the company (hopefully) has realized their error and given up. If you see another rebuttal by the company but not from me, it is because I don't have the time or the energy to proceed with this any further (I have a normal life to live) and I feel that providing you with all the facts that I possibly could will result in you being able to make an educated decision about this company, and that's all I want now. Only in the event of a legal action will I continue this ridiculousness. I have no desire to carry on a bad mouthing tournament with these people any longer. My evidence speaks for itself. You now have all the information that I have.

This person has been harassing us and we had no option other then to Auto Delete his e-mails. Was sent one shirt per his request. The customer wanted his shirt for free. Sorry but no comapny give items away for free. He did not absorb anything other then paying for a shirt that he ordered. The Better Business Bureau (BBB) has agreed with everything that we have done with this customer. He is angry that he did not get his merchandise for free. We do not send customers merchandsie for free and he does not understand this. The Better Business Bureau (BBB) agrees with our comapny and we will let it at that. You the consumer can clearly see what and who is to blame here. Our company does not have the time to deal with dishonest people.We will not spend anymore time with people that lie and try to be dishonest. We are to busy processing orders to honst people that understand you need to pay for items for them to be shipped.Our customer rating shows how our customers are happy with our service.This guy has too much time on his hands. If any more false statements are made by this customer we will have to take legal matters.

Since this Rip-Off Report was first issued I have made contact with the Better Business Bureau (BBB) regarding my case and they attempted to come to a resolution with this company, and failed. The company vehemently rejected any proposals that were given to resolve the issue. I have absorbed the damage of these events and my only true retribution was through this website, being given the opportunity to tell other consumers about my experience.



When I was contacted by email regarding the rebuttal given by the company, I was (and am) appalled that they are trying to tell you the consumer that my statements are untrue. I have email documentation proving the events that took place that I kept record of for the BBB case. I have been added to this company's Auto-delete list for their email, further proving their lack of cooperation at all in trying to resolve this matter.



I stand by my statements in my original report, and furthermore it is my opinion that the only reason this company is challenging my report is because they are afraid you will believe the truth about them. I ordered (2) shirts, and they sent me only (1) WITHOUT my permission, and AGAINST their policy at the time.



I never exaggerated any of the details of this report, either. What I say is exactly what happened, no more, no less. I considered myself to be very fair in that respect, not stating my opinion unless obviously saying so. I will say in the company's defense that it was only shirts that were in question, not really a big deal to most people, but it is a reflection of their ability to follow through with their policies as they were stated on their website at the time (they have since this event changed their policy to reflect partial shipments being acceptable without customer notice, but my original report shows their previous policy). It also was Christmas Season, so maybe they are just less concerned with customer satisfaction during times of the year when sales are high and overwhelming. Anyway you look at it, though, it just spells out B-A-D B-U-S-I-N-E-S-S.



So be aware that if you deal with this company and you have any problems regarding your order, their is a strong possibility that your requests for help or attempts to fix the problems may go unheard (or at least disregarded).



I leave it to you the consumer to make the decision you feel comfortable making regarding this company.

This Man is not telling the truth

He was e-mailed and we told him only one of the shirts were available.He said send the one shirt and we did. He was only ever charged for one shirt and was never charged for two. The second shirt was not available and he knew this and did not have a problem with this at all. Now reading this statement of lies he just not right and unjust. to me and my company. We are a well respected business and never rip off and of our customers.All the policy that he is quoting is not what we wrote is replaced the words woth his own just to discredit out company.
