My husband and I was contracted by 1st Choice Facilities of Sarasota, FL to move an Advance America store from Hazard, KY to Middlesboro, KY back in June 2010.  They told us it would be 45 days for payment and to this date we still have not received payment for work we completed with this company.  So, my husband and I are out our time, labor, gas, and about $400 in cash with shipping their keys, money gram box, etc.  I have contacted them several times and first they told us they would pay us at the end of July 2010 and now when I call all I get is a bunch of excuses from Dawn in Accounting that it is not up to her to cut a check.  However, they keep making excuses as to why Regina (supposedly the one in charge of cutting checks) that she was in a car accident, she is out sick, etc. etc. etc. My husband has been laid off for some time from the construction industry, was on unemployment, finally found a job after 1-1/2 and was laid off again after 4 monts, and now we cannot sign back up on unemployment.  So, we have no income.  We did this job like the next day after he got laid off because we knew we would need the money.  We took our last $400 in cash and paid it out for 1st choice facilities so they could break a lease for Advance America and move the stuff from one store to the next.  If we had known what we know now about these scumbags we would have not even done the work.  However, we were desparate and still are because we have no income and they still are making money off the sweat of others and stealing from innoncent families to fatten their pockets!  What a shame, if I was the employees who worked for this company I would be embarrased at their work ethics!  So, we will try to sue for our money, contact the better business bureau and hope that this will make a difference that this does not happen to someone else.

A few years ago they contacted me to do some work at a Yankee Candle store. I completed the work without issue, and the store was happy. About three months and twenty phone calls later, they still refused to pay. I finally contacted Yankee Candle corporate, and told them that I was going to sue THEM. That got the ball rolling, and they finally paid.

I have been an independant handyman for many years, and have worked with more of these maintenance companies than I can count. MANY are scammers and just don't pay.  The one thing that almost always works is to contact the store you did the work for. Politely and professionally explain the situation, and tell then that you are unfortunately going to have to sue them, as you work your way up the ladder. Let them know that you are still hopeful that the legal process can be avoided, and that you are hoping everything can be straightened out with a few phone calls.

Trust me, big companies don't want to get sued, they will make the phone calls that matter, and 99% of the time you will get paid.
