This August, my wife and myself went into the 24hr Fitness of San Juan Capistrano to inquire about signing her up for a new membership (I am already a member). The salesperson we spoke with and are referring to here is Justin Saunders.

We did not want the first package he suggested, as it was too much money for our budget. He practically wouldn't let us leave or give us our credit card back until we agreed. After several minutes of pressure to buy the package, he offered us the same package, with the restriction of any four times a week. Both my wife and myself confirm him verbally telling us several times that you can go whenever you want, any four times a week.

When my wife came in on tuesday, 8/22, she was told by the front desk that her membership was restricted to Mon, Wed, Fri, or Sundays only.

Mr. Saunders did directly and verbally tell us several times that she could workout any four times you want, you choose.

He never once informed us that there were only certain days available to her.

On Wednesday, 8/23, I went to the branch and spoke with Mr. Saunders. He said he was sorry, and you should have read the contract. When asked why he told us any four times, he said he was sorry he said that, but there was nothing he could do now, except for us to upgrade for $79 more.

Since these days do not work within my wife's schedule, I requested that we simply get our $129.30 back. He refused, and sent me to his manager Jason Komala. He said he was sorry that Justin said that, but there is nothing I can do about it, but I would be happy to upgrade your membership for $79 more.

some of these things that you are saying can be handle at the front desk. for one you got a membership which is either mon., wed. fri & sun or tues. thurs. sat & sun. first of all how did the salesman got your credit card in the first place. that is like going into a car lot and giving the salesman a check for whatever he wants ,before even buying the car. he knew he could get you on a ssle. so that is why he didnt give you back the card. as far as changing the dates you could of done these things.
1) decide if those dates would fit your schedule, the days i listed above.
2) if one of these schedules did work out and was different from the agreement, then go to the front desk and ask to change your dates to the other option (this is a one time thing. so make sure its your right choice)he/she can do this on an EFT form.
3) upgraded for $79 like they said that would of given you access to anytime you felt like it.
4) the manager was right it says what dates you can go right next to where you sign
5) cancelled within 3 days and got your full money back
