I have been a member of 24 Hour Nautilus/Fitness Clubs for 23+ years. I have an all club membership and pay an annual $99.00/year guaranteed for life with no monthly dues. When they were about to open the new Super Sport facility adjacent to the current 24 Hour Fitness Club I was advised that my membership did not provide for entrance to the new club. I felt then as I do now that I should be allowed to use this new facility based on the verbage of my original contract with 24 Hour Nautilus/Fitness.

24 hour bait and switch

I have had my 24 hour fitness membershp for 11 years without issue after paying a significant initiation fee and the 14.99/month for the 11 years. Now they tell me that my "ALL" access membership is not all access. They say that super and ultra sport clubs have more and new services. This bait and switch screams for a class action. Thier creative interpertation of the contract aside there is absolutely no basis in a conractural sense to their claim of new services. 99% of folks bought memberships to work out and that it what any of thier newly named clubs provide, a place to workout. I'm more than happy not to avail myself of the opportunity to purchase the overpriced juice at a juice bar (they conside that a new service). I suppose mens rooms with diaper changing stations could be considered new services using that logic. The clear intention is to circumvent the explicit and implied intention of the contracts by creating non-substantive distinctions to the physical structure of the facility yet they can not deny that the primary purpose of the club whether it is "super" or "ultra" is the same as any other club.

I have been involved in class actions before. They take a long time but if you are persistant and have a legitimate claim they always work. I know that many many folks have been ripped off by 24 hour fitness and have similiar claims. I'm presently taking offers from any firms that are interested in taking this class action. THere may be other classes in the initial stages and I would be more than willing to join with them as a joint "named plantiff". My only fear is that the ultimate result will be for 24 hour fitness to utilize chapter 11 and wipe out all of our value by reorganizing.
