A. Rincon Transportation hauled a load of berries, but they ended up delivering the load 2 days late. Product was rejected at consignee due to decay. Also, reefer download shows a 12 hour period where the reefer malfunctioned and the return airflow temperature ran well above the temp as outlined on the bill of lading which most definitely contributed to the decay. The claim amount is $19,218.00. We are pursuing litigation due to the carriers insurance not taking responsibility. We have all documentation to support this claim and have made several attempts with this carrier to settle this claim.
