I started a two year cell phone contract for my son in April. Six weeks later we found out we were moving cross-country and that A T & T Wirelss does not have service in our area. Wehn I asked to cancel it, they said I was two weeks past the 30 day change clause and I had to pay for the full two years even thought the phone can't be used in our new area. (MA/413 area code)

They said my options are to pay the cancellation fee ($175 - 225.) or get someone who can use the phone to take over the contract. I find this incredibly unfair and think the law should be changed but want to know if there is anything I can do to get out of this contract.

I don't know of anyone who wants this phone or wants to take over the contract.

Thanks for your help.

Sell the phone and contract on EBay

#2Consumer Suggestion

Wed, October 01, 2003

I encountered this with TMobile, but they let me out of the contract when I moved. I had used them for years, though.

Here is my idea for you. I have seen a lot of phones with plans being sold on EBay, or any other auction site. Try that. Just be sure to have everything ready and detailed in your selling description. It will cost you a little to put your ad at EBay,(less than 5.00) but it will be worth it in the long run. Some people will tell you to avoid EBay, but I have had great sucess with selling and buying for over 3 years now.

GOOD LUCK!
