We refinanced our home with abn amro In 2001 BIG BIG BIG Mistake

In August of 2002 we receive a letter from our insurance company that they were cancelling our homeowners insurance due to lack of payment. So immediately I called abn amro wanting to know why they had not paid my insurance when I knew for a fact that the money fro my insurance was in my escrow acct. They said that they did not know where to send my insurance payment. Yeah right they had all of that info when we close on our loan. So I gave them the info needed and they made the insurance payment.

All was good until August 2003 once again we receive a letter from our insurance company stating they were canceling our insurance for non payment and this time they would not accept payment. (2ed year late) So once again we called abn amro. Well if you have ever had the misfortune to have dealt with this company then you know how the responded IT WAS OUR FAULT THAT THEY DID NOT PAY MY INSURANCE FROM MY ESCROW!

Even though our money was in our escrow acct. Well in June of 2003 another mortgage company we were thinking of refinancing with requested a payoff from abn amro on our loan.

They sent us a copy of the pay off letter on the back of this letter it states If the escrow balance is being credited to the payoff balance, we will not pay any taxes or property related insurance while this letter is in effect. This letter was to expire in 30 days .

Letter dated June 11, 2003 should have expired July 11, 2003 Right? Well our insurance was due on July 24,2003 and a copy of my insurance bill was mailed to the company on June 9, 2003 so the letter was expired before my insurance was due why didn't they pay my insurance??????

BECAUSE THEY WERE NOT RE BILLED AFTER JULY 11,2003 that is what they said. My comment why would my insurance company re bill you after July 11 when the bill was not due until July 24, 2003. Well they didn't have an answer for that we were just simply told that they didn't pay the bill because of the payoff letter and even though the payoff letter expired on July 11, 2003 before my insurance was due they should have been re billed. BULL CRAP

Why would my insurance company send out another bill on july11 when the bill wasn't even due until July 24 and they had already send the bill out on JUNE 9 DUH!

Well any way my Insurance company would not accept payment and was cancelled For non payment. My Insurance was 315.00 A year for $190,000.00 of coverage

ABN AMRO still insisting was our fault not theirs put the famous forced placed insurance on our home with a cost of 1121.00 a year for 95,000.00 of coverage on the structure only. WOW

Having lost a home to fire on December 21 1996 I know how important homeowners insurance is and with out it we would have been homeless and with ABN AMRO'S forced place insurance if our home were to burn down this insurance would only pay off their loan and there would have been no coverage to help put us back on our feet.

So with their forced placed insurance our house payment went from $750.99 a month to $933.00 a month I know this is not a lot for some people but where we live people here are lucky to make that a month.

Well I called them constantly to get this resolved I let them know that this was THEIR FAULT not mine they had my money in escrow to pay my insurance and didn't pay it they acted like they were stupid and didn't get how I thought it was there fault.

Well I called many lawyers and no one could help us without a huge retainer fee finally in Oct 2004 with my husband being laid off for 7 months we just couldn't make that payment any more I called abn amro JOKE told them it was either food or the house payment and asked then to defer one months payment to the end of the loan WELL THEY JUST DON'T DO THAT but the did offer to brake the payment we missed in Oct down to three payments and add that to the $933.00 monthly payment I told them We cannot afford that and once again told them it was their fault our payment was so high their response pay it or we will foreclose.

So from then on the did not get another penny from us We finally found a very good lawyer to look at this case and MY GOD someone other then us saw just was abn amro did it is called BREECH OF FIDUCIARY DUTY!! LONG LONG story short we lost our home of 9 years and the family property of 54 years all because abn amro was NOT RE BILLED LOL

We now have a lawsuit filed in the district court of Maryland we are suing on 9 different counts of course they are trying to get out of this they are trying to get the lawsuit dismissed on statute of limitations. WE will see what happens

You know this lawsuit is not about money it is about ABN AMRO MORTGAGE STEALING OUR HOME JUST BECAUSE THE WERE NOT RE BILLED That home was the only home my youngest son had ever lived in and that property had been in my family for 54 years and I had always said from the time I was little I was going to live in my grandmas house and at the age of 19 I moved in that house my oldest son was 2 and a half we moved in and all four of my children were raised on that property with the exception of the 3 months we lived with family following the house fire.

We will never get our home or family property back. If we win this lawsuit GREAT maybe we can buy another home for our family (WE CAN'T NOW FORECLOSURE) but if we lose this lawsuit and that might very well happen I JUST WANT EVERYONE TO KNOW HOW ABN AMRO HAS TAKEN OUR HOME!!!!!!! I would love for someone from abn amro to have to explain to my children why they just had to have our home and why every time we go to visit our family we have to pass what was our home.

The loss of our home to fire was extremely hard. But this was/is the hardest. This lawsuit is not about money but with a company this size you cannot make them hurt like our family has hurt crushed hopes, dreams, and very broken hearts. So the only thing you can do to a careless, thoughtless, heartless, company is to try to get them where it matters most to them THEIR POCKET.

I have read your comment and I see where you wrote that YOU pay your insurance good for you I really wish we would have done that but our loan was escrowed. It was the responsibility of abn amro to dispurse the funds to pay our insurance. we paid our monthly bill which included our escrow payments. as for the insurance company thinking we were high risk because of the fire in 1996 (which by the way was caused by our wood stove and no one thank god was home at the time) that is not true our insurance company was well aware of the fire in 1996 and they still wrote our policy. our insure company sent out a yearly renewal bill and was renewing our policy untill they did not recieve their payment. If I would have known that abn amro was not going to pay my insurance before I recieved the cancellation letter I would have paid them my self amd then delt with abn amro. but when I recieved the cancellation letter fron the Insurance company in August i call the insurance company and I could not make a payment on my policy because it had been cancelled for non payment. WE could not renew the policy now because we had 2 WEATHER RELATED CLAIMS with them (5FT snow & ICE ) our whole roof was leaking and no power for 2 weeks we lost out food. AND I DID try to obtain Insurance else where but because of those claims we could not get insurance so we had no choice but to pay the forced place insurance. LET ME JUST CLEARIFY THIS my policy (regardless of the weather claims we had filed) wes being renew untill NO PAYMENT WAS RECIEVED. And by the way This was my own insurance.

I've had an abn amro mortgage for 11 years and never a problem. Statements monthly detailing payments received and disbursements made ( taxes ). I make my insurance payment to State Farm and that info is automatically transmitted to abn amro. As long as you keep a policy in effect, there is no issue. I hate to say it but it sounds like after the '96 fire, you had difficultly obtaining coverage so you went thru abn amro as a buffer untill the insurance co discovered who they were insuring and decided you were a bad risk. From the insurance co veiwpoint, there may have been questions over that fire that put you on a undesirable list. All I know is insurance is obtainable on your own. You sure don't need to get it thru a mortgage co.
