I wrote a check to Circuit City for a birthday gift that was returned by my bank. During that time two things happened: I lost my job and I had some fraudulent activity go through my account that caused it to be overdrawn by the time the check was presented. I did my best to try and pay off the check, but being without an income it was hard.

I had been paying on the debt when I began getting letters and threatening phone calls from attorney Norman G. Kalina's office. I received a phone call from them today threatening to take me to court. The people there are very nasty and demanding. When I tried to explain my situation, they didn't want to hear it. I told them I was willing to make payments until the balance was paid off, but was told the balance had to be paid in full. They even had the nerve to add "attorney's fees" to the bill.

After doing some checking, I have now found out that this office is not a law firm at all but a collection agency using Mr. Kalina's name to intimidate, threaten, and harrass people into lining their pockets. I have sent an email to the company who originally had the debt in hopes that I can finish paying them off and eliminate the harrassment from my life.

People, beware of this company!!

Collection agents have all sorts of dirty tricks. one of which is to pose as a lawyer or to imply that imminent legal action will be taken.

a collection agent has no legal power over you. If they continue to call alleging legal action, request to know the full name of the attorney and his/her license # in the state bar association. If they ARE taking legal action you are entitled to speak with the attorney per federal law.

Note: a bad check presents more of a problem than missed credit card payments. Be careful with this situation.

FYI: If you make any sort of deal with this firm. GET THE TERMS IN WRITING. do not accept any "deal" to settle the debt over the phone.

NEVER EVER give them your bank account info/debit card #. If you do they'll take far more than you authorize, which could create an avalanche of bounced check fees.

DO NOT make any payment via Wester Union. Make any payments via USPS money order if you eventually pay them and don't forget that written contract first!
