This relationship between seller and realtor went completely and totally down hill. Unbeknown to us, in the "World of Realtors" it is circulated that Mr. Landis is known to have an unsavory reputation with his clients, display bad business practices and not well liked amongst his peers. There's no way we feel Mr. Landis, at this point in time, has our best interest at hand going forward and are totally confused and frustrated as to why Mr. Landis would want to continue such a non-constructive, volatile and hostile relationship with a client, meaning, why put us through such heartache and turmoil? all the while Mr. Landis, at any point, can simply do what would be proper and necessary and let us go our merry way.

Pursuant to paragraph 17 of the standard CRMLS Exclusive Right to Sell Listing Agreement signed by property owner-seller, an "EXCLUSIVE RIGHT TO SELL" listing means that if you, the OWNER of a property find a buyer for your house, or if another BROKER finds a buyer, you must pay the agreed commission to the present BROKER.

This rebuttal conveniently left out the beginning of the "Pursuant to paragragh 15 of the standard (CRMLS) exclusive right to sell listing agreement" which states, "I understand that I may revoke the LISTING BROKERS authority to be my agent at any time". I understand that the contract rights can be retained. The point is why not just terminate the contract altogether and stop the anger,grievance,hardship and protest that my wife and I are experiencing. Access Premier Properties is a very small business competing with large real estate corps. and desparate for any business they can generate and would rather hold on to their clients at any cost by any means necessary.

Under no circumstances will an unconditional withdrawal and/or release be provided after property is listed on the Capital Region Multiple Listing Service (CRMLS).
Pursuant to paragraph 15 of the standard CRMLS Exclusive Right to Sell Listing Agreement signed by property owner-seller, the listing broker shall retain its contract rights, which may include but are not limited to recovery of its commission, advertising expenses, and/or other damages incurred by reason of early termination.
