Adcom Service David Ochoa Failed to Provide Refund after Breach of Contract Houston Texas

I invested in a business, named Adcom Service and in less than 2 months I was provided false hopes and promises from the owner, David OCHOA as per our signed contract agreement.  For months OCHOA and myself disputed our versions but at the end of the day OCHOA was in breach of contract, claimed he had no money, and did nothing wrong.  OCHOA and I settled to terminate the original contract and OCHOA agreed to make monthly payments as a refund to the money I invested. OCHOA completed the first payment only and followed with dozens of excuses as to why he could not pay. OCHOA had breached a 2nd contract now and to this day OCHOA still has failed to repay the remaining balance.

On Feb.14, 2018,  I began email and phone discussions with OCHOA, about investing in his marketing/advertising business model.  I was excited and ready to take on this venture.  I had completed my due diligence after speaking to several Adcom Service business associates and sister company owners.  One owner, Dora PARMENTIER, mentioned that she had nothing to do with OCHOA and was running her business without any support or connection to Adcom Service.

On Mar.8, 2018, I wire transferred $30,000 USD to OCHOA following signing the agreement on time, as per our arrangement. This was a business model that required a website to be created, staff hired, leads generated, training, commissions paid and more by Adcom Service.  This concept was similar to franchise, as OCHOA was selling his notion to business minded individuals like myself.  All of the details on the agreement were understood.

By Apr.2, 2018, I was experiencing several inconsistencies with OCHOA and the agreement we had. I was ready to do business after 3 weeks and was advised to just wait.  I was declined to use my logo design, was provided a website that was a complete copy of other business owners just a different domain name. I was also provided numerous company documents, such as forms, templates and training material in PARMENTIER's name. 

On Apr.30, 2018, I emailed OCHOA again, and started to voice my concerns that I was frustrated with the lack of action and false promises. I was considering an exit strategy. This was only days after OCHOA and I had a heated phone conversation that I wanted my money back. OCHOA claimed he had no money but had originally told me the business had earned over $500,000 in the first 3 months.  After 52 days, I has not happy.  The terms of the agreement were not being met and I was told excuses day after day until OCHOA held me responsible for his health and that I was harassing him.

On May 18, 2018, I spoke with OCHOA's business partner Wayne GOLDEN whom was more calm and willing to listen.  GOLDEN assured me that I would be refunded some how and seem to understand my concerns.

On May 23, 2018, I served via email, a Breach of Contract notice to OCHOA. This caused a reaction from OCHOA that he in turn wanted to seek legal action against me. OCHOA was blaming me for putting him in the hospital with a stress triggered illness. Three days later OCHOA agrees to refund and repay me back on monthly instalments of $5,000 that would commence in 30 days.  I was aware that OCHOA was still paying back "Michelle" (sister company) after 2 years.  I spoke to "Michelle" whom had the exact experience as I.  "Michelle" was angry and wanted OCHOA to contact her about the money he owed.  I followed up and spoke to GOLDEN who stated that "Michelle" was mentally unstable and her issues were not of the same as mine.  It tool a month to get a signature from OCHOA to acknowledge the repayment agreement.  This was normal from OCHOA.

 On June 25, 2018, the agreement was signed to repay $20,000 USD in four payments ending on Oct.25, 2018. The first payment OCHOA made was late by 6 days. The 2nd payment was never made and an amount of $2500 was wire transferred to me on Oct.12, 2018.  I made several attempts via email/text message to request for the late payment but OCHOA had an excuse for everything and anything. GOLDEN was now out of the picture and never replied back.  OCHOA was claiming that his payments were voluntary and would only be made when he had the funds from selling his business model to individuals, just like I did.

On Nov.26, 2018, OCHOA emailed me to advise he was waiting for another "buy-in" and that he had hopes of selling his business in the new year.  OCHOA like usual, did not address the repayment of funds that he agreed as per signed document.

 It has been nearly 7 months of efforts to terminate and exit doing any business with Adcom Service.  I honestly believe that any future investors/entrepreneurs that choose to engage in business with OCHOA will suffer financially just as I did and continue to do so.  All I wanted was to start this business with the terms that I signed up for. It did not take long to lose trust in OCHOA when I became a victim of his business strategy.  I ask myself why did OCHOA not want to assist his investors?? I recalled a conversation when I asked for a refund, and OCHOA replied that he spent my $30,000 and had no money.  After 7 years in so called business, OCHOA was broke but had a $10,000/mo expense to save and feed dogs at his house.  I have made note that OCHOA has since changed his email address and I have over 100 saved emails/text messages between us both.  As a retired police officer, I am very knowledgeable of fraudulent offences and this is no difference.
