I have never been this upset!!! I decided today to go by an Advance America Cash Advance office. I asked them what their fees were and the woman behind the counter pointed to a sign on the wall.

To make a long story short, I decided to go ahead and give her my information, bank statement, paystub, drivers license and s.s. number. I asked her if there was an application that I needed to fill out and she gave me this little info card to put my name, address, and three references on. I filled it out and gave it to her, (mind you, I didn't sign anything giving her permission to run my credit).

She made copies of all the information and gave me back the orginals. Once she started to put my information into the computer, I decided that I didn't want to go through with it and asked her for my information back.
She gave me back my drivers license and blank check. I asked her if she would also give me back the copies of my information she made and she refused!!

She said that they had to keep copies of the information and than pulled out an employee handbook that stated that they were to keep copies of info for pending and incomplete applications.

I reminded her that my information was not incomplete and it wasn't pending because I changed my mind before anything was done.

There were no signs in the office stating that and as far as I am concerned she stole my information. I asked her to call the police and they told me it was a civil matter and to to take it to court. I am now looking for a lawyer to help with this situation. No way can this be legal. I never signed anything giving them permission to access my personal information and now they have it they are free to do whatever they want with it.

Actually, due to discrimination laws, they are required to keep records on all people who filled out paperwork, whether they were denied for cause or whether they changed thier mind about the loans.

There was a lawsuit made by a woman who had tried to scam advance america claiming she was denied for a loan because she was black, even though it was because she had ripped off other payday lenders. Since then, they have to maintain records.

I work for advance america in az,

it is our company policy that if you apply for a loan we need to keep your documents, your information never gets shared and is put in a confidential filing cabinet. you have nothing to worry about. If your information was put in the computer we need to have documentation. We do not run your credit hence why we ask for so many things when you apply. On your application when you fill it out it says you authorize us to verify any information that you have given us.
