At this time, I have resolved this dispute with Advantage Builders. We both had a difference of opinion, but over time we worked together to settle the matter. I tried to delete the above report for Tom and his company, but once something is posted on Ripoff Report it cannot be removed. I am posting this rebuttal to rectify this matter the best way that I can. Mike Lee

My name is Mike Lee and live in Henderson, NV...The response from TOM Delahunty aka Advantage builders of Nevada was just brought to my attention this last week...After spending 16 years in the military and being a disabled Veteran from injuries suffered defending this country and dealing with many different personality’s in life and the with the he said she said Scenerios I say this! The 1 thing I learned is that I do not need to write a story on defending myself on this page...If your reading this you can call me on my cell # (((REDACTED))) for a honest response and a honest opinion, I’m available 24/7....The other thing I learned is to always record all contracts and interactions with contractors and sub contractors and family members when it’s concerns money! Thank the lord that my security cameras and the neighbors recorded every word from this encounter beginning with the day my house burnt to the ground, video and audio don’t LIE! Please call me if you need any assistance...Respectfully Mike M.Lee

Owners Rebuttal

#6REBUTTAL Owner of company

Thu, December 08, 2016

As the owner of Advantage Builders of Nevada, Inc I must respond to these false allegations. I have been a licensed contractor in California and Nevada since 1993. In that time I have rebuilt approximately 1,000 homes and to this date I have never been sued by a homeowner, fined, cited or sanctioned by the state contractors board and I have always been a member of good standing and maintained an A rating with the Better Business Bureau.

The person who wrote the statements above did not use his real name because he knows the claims he has made are false. Also, this was a house I didn't rebuild. Yes that's correct, the one negative comment on the internet is from a job I didn't do.

He claims he cancelled our contract on the second day after signing it but here are the actual facts:

11-30-15   This person had a large fire at his house in an affluent Henderson neighborhood. My company represenative was there along with several other competing companies. He selected my company to perform the emergency board-up services only that day on his large 2 story house. He took my company brochure and references along with the other contractors information and said he would do his homework on everybody.

12-3-15   Three days later he called my represenative and informed him he did his due diligence and that we were an honest company with a clean record so he decided to hire us and he signed our contract that day.

12-7-15   On this day, 4 days after the contract was signed, myself and my represenatives met with the represenatives of his homeowners insurance company at the burned house. We spent several hours discussing the scope of repair work and which items would require further negotiations. The homeowner was present that day and actually stated he was impressed with how we were able to challenge his insurance company and win arguments which would lead to a higher settlement. Remember, this was 4 days after he signed the contract and hired us. If he had cancelled us on the second day like he now claims why did he allow us to do our job that day? Why didn't he tell me face to face I cancelled the contract a few days ago?

Due to the large size of the house and the fire the negotiations and settlement process lasted from Dec 7, 2015 until the beginning of April 2016. So we fought and battled the insurance comapny and their vendors on the owners behalf for over 4 months in order to reach a fair and reasonable settlement, which finally concluded at $395,000 plus a handful of small open items. He was kept updated during this entire process, if we had been cancelled on the second day like he now claims, why were we allowed to continue doing our job?

4-12-16    On this day, 4 months after being hired, we met with the owner at the property to discuss the reconstruction process along with some changes he had in mind and had mentioned to us earlier. If we were cancelled on the second day why did he meet with us 4 months later? At this meeting he admitted to me that he had been talking to different truss companies, framers and others which was a surprise to me. He also told me that day how he had past construction experience and he had actually been arrested a few years earlier for I believe it was contracting without a license. He stated he was angry because the District Attorney and the Contractors State License Board had conspired to arrest him at home on a Friday night so that it would happen in front of his wife and kids and also because he would have to spend the weekend in jail. I told him that day if he wanted someone else to do the work I would put together an invoice for the work we had done and what he would owe us.

So basically this owner used me and my company for 4 months to achieve a large settlement to rebuild his house. My contract has a clause that states if an owner cancels my company AFTER 3 days, the company is entitled to 10% of the structure settlement plus the time and material put into the job. That's why he is now claiming he cancelled the contract on the second day, but as you can see he never did cancel the contract and instead allowed us to perform our job for 4 months. In fact both myself and my lawyer have requested any type of proof that he cancelled the contract on the second day, but those requests have been ignored.

So as you read this information please keep this is mind, this person would not even use his real name. Getting these lies and false allegations removed from this site literally takes a court order and my lawyer is working on that now. This owner tried to use me and my company's experience and RIP ME OFF and he's upset that I didn't allow that, so that's why he lashed out and wrote these lies.

My company is and always has been a clean honest company, but unfortunately we now live in a world where anyone can write anything about anybody on the internet. I will gladly compare my record and my reputation with any other contractor. The facts are for over 23 years I have maintained an A rating with the BBB and I have never been fined, cited or sanctioned by the state contractos board. I have rebuilt approximately 1,000 homes in that time and the only negative comments on the internet is from the owner of a house I DIDN'T EVEN REBUILD.
