I get a call from a concerned client today telling me another agent called her without her permission, and asked to sign her up on a Medicare Supplement plan with Aetna. They wanted her social security number, and checking account info and they wanted to put the application way outside the legal application guidelines set by Medicare. By law she couldn't apply until 3 months before her turning 65, this is months before that date.

He also gave her a false name, Frank Schaw, which turned out to be false. I had him contact me and I saw a 5-9 dialer tab open and it had the company info on it: Advice and Life Group. You are not allowed to have a dialer and call people without permission (it's against federal law). It is also criminal in Ohio to contact a Medicare beneficiary without permission. 

By furnishing these tools to their agents, they are allowing their agents to break the law noticeably. The quote machine is also provided by the company.

I looked up their company and the branches they have say they separated from their service over a year ago. So they have an unupdated site as well. Everytime I call their number no one answers, and if you choose the customer service number it autodisconnects you.
I found their phone number on the DOI in several states it is a dead number.


They recommended to a client that they take an app (WAAAY OUT of IEP), they were pressuring her for her payment information and brought other people on the phone (I guess to close her).
The agent recommending her to sign up outside IEP and hand over all their personal information is Frank Schaw. The principal of the Advice and Life Group is Perry Santillo Jr. I wonder if he knows agents under him are breaking the law...(which by the way his corporate number on the doi of many states doesn't work).

Was able to speak to the guy (left a message saying I was a friend of the client he called), he gave me many lies and inaccuracies. His name is Shah Fahad NPN 17370790, he came clean about his name after I got him on a web-conference and saw his name for the logins. He's from Ft. Lauderdale...

So saying crazy lies, taking applications outside of IEP, and using a fake name to get sales. Also the company asked that I take down the post from another forum warning seniors to not trust this man who is illegally transacting insurance sales. The question is, does his company continue to allow this? They are violating TPA laws if they are furnishing dialers for their agents without processes in place to scrub the dialer against the DNC AND TPA. I asked Shah (Frank) why he was allowed to call my client without her permission and he said that Medicare and Social Security put out a list of Medicare Beneficiaries when they turn 65 and that they were allowed to contact them to explain how Medicare works.

LIES!!!

I have reported them to both the FL and OH department of insurance.

To those involved

My name is Perry Santillo Jr.  I am the Proud owner of mid-size insurance agency located in Ft. Lauderdale FL.  Our mission is to provide surperior service and competitive prices in an industry riddled with commission hungry agents.  I'd like to address the misinformation provided by the previous post and thank the agent for informing me that some of our the phone numbers listed on the various state insurance states are out of date due to the fact we have grown and moved to larger facility (This will be corrected today).

I will now address the inaccuracies of the previous post and invite the individual that posted it to verify my statements via appropriate governing agencies.

THIS IS CORRECT  YOU CAN NOT APPLY FOR MEDICARE UNTIL 3 MONTHS BEFORE AGE 65.  FORTUNATELY WE DO NOT SELL MEDICARE, IN FACT NO ONE SELLS MEDICARE, AS ITS A GOVERNMENT PROGRAM ITS NOT SOLD.  WE DO SELL MEDICARE SUPPLEMENTS WHICH CAN BE SOLD VIA OPEN ENROLLMENT "IEP" (WITHOUT UNDERWRITING) 3 MONTHS BEFORE AND UP TO 3 MONTHS AFTER TURNING AGE 65.  NOW CERTIAN INSURANCE CARRIERS (SUCH AS AETNA, MUTUAL OF OMAHA, CIGNA, ETC.) DO OFFER AS A COURTESY ENROLLMENT UP TO 6 MONTHS PRIOR TO TURNING AGE 65 WITHOUT UNDERWRITTING THIS ALLOWS THE POTENTIAL CLIENT TO LOCK IN A PREMIMUM. THIS IN ABSOLUTELY NO WAY "BREAKS THE LAW"

THE REP MENTIONED IN THIS REPORT NAME IS FAHAD "FRANK" SHAH.  FAHAD DOES GO BY FRANK ALTHOUGH HIS LEGAL NAME IS FAHAD.  THIS IS VERY SIMILAR TO REPS I HAVE BY THE WILLIAM WHO GO BY BILL, OR WILL OR BILLY I ALSO HAVE REPS NAMED RICHARD THAT GO BY THE NAME d**k, PAMUELA GO BY PAM, SAMANTHA GO BY SAM.  I WILL ADDRESS THIS OVERSITE WITH FAHAD AND ENSURE HE USES HIS FULL LEGAL NAME AND EXPLAIN TO CLIENTS HE GOES BY THE NAME FRANK.  THIS WAS IN WAY DONE TO AVADE HIS TRUE IDENTITY (AS  YOU CAN SEE HE HAS A CLEAN LICENSE) THERE NO MALE INTENT, THIS HIS DAY TO DAY NAME.

THIS IS ONLY HALF ACCURATE.  THE PURPOSE OF HAVING HAVE A DIALER IS TO REMAIN "DNC" DO NOT CALL COMPLIANT.  WE ALSO MAINTAIN OUR OWN INTERNAL "DNC" LIST, THIS IS A COMPLIATION OF NUMBERS THAT ARE NOT ON THE NATIONAL DNC LIST THAT HAVE ASKED TO BE REMOVERD FROM OUR  CALL LIST.  WE ARE 100% DNC COMPLIANT WE UPDATE WEEKLY VIA SANS (OUR SUBSCRIPTION ACCOUNT NUMBER "SAN" 10267104-367104-15 NUMBER IS).  WE HAVE NO DESIRE TO BE PESTY TELEMARKETERS WE RUN A CLEAN HONEST BUSINESS.  FIVE-NINE IS ONE OF THE MOST RECOGNIZED DIALER SYSTEMS IN THE INSURANCE INDUSTRY FOR THE REASON THE REQUIRE ADDITIONAL COMPLIANCE TO PROTECT THE CONSUMER.  WITH REGARD TO DIALING WITHOUT PERMISSION AGAIN HALF CORRECT, THE REQUIREMENT IS YOU SCRUB FOR DNC AND  AFTER CLEARING YOU CAN NOT "ROBO DIAL" THIS IS WHEN YOU USE A MACHINE TO BLAST DIAL 100'S OF PEOPLE PRERECORDED MESSAGES OR SOLICIT A PRODUCT TO THE MASSES.  PLEASE UNDERSTAND WE DO NOT EVER ROBO DIAL WE USE WHAT IS CALLED PREVIEW DIALING WHICH MEANS EVERY ONE OF MY REPS MUST PUSH THE DIAL BUTTONS AND WAIT FOR THE PHONE TO RING AND THE PROSPECT TO ANSWER.  LET ME MAKE THIS VERY CLEAR I TOO HAVE A PHONE, I TOO GET ANNOYED WHEN TELEMARKETERS BLAST MY PHONE, I DO NOT AND WILL NOT EVER ALLOW SUCH ACTION.  WE ARE 100% TPA AND FTC COMPLIANT!

OUR CLIENT SUPPORT NUMBER IS 866 937-0408. WE HAVE ONE OF THE STRONGEST CUSTOMER SERVICE AND CUSTOMER SUPPORT DEPARTMENTS IN THE INDUSTRY, THIS IS THE LIFE BLOOD OF OUR ORGANIAZATION.  PLEASE UNDERSTAND IN THE INSURANCE BUSINESS THE ONLY THING THAT SEPERATES A GOOD AGENCY FROM A NOT SO GOOD AGENCY IS THE CLIENT SUPPORT AND ABILITY TO OFFER BEST POSSILBE PRODUCTS WITH AN UNBIAS OPINION. THE REASON WE MAINTAIN A DIALER AND A QUOTE ENGINE TO PROVIDE THE BEST POSSIBLE PRICE ESPECIALLY GIVEN BY FEDERAL MANDATE ALL MEDICARE SUPPLEMENTS MUST IDENTICAL, WHICH MEANS UNLESS YOU HAVE A CARRIER PREFERENCE PRICE IS THE ONLY VARIBLE.  FOR THE RECORD I JUST TRIED OUR CLIENT SUPPORT NUMBER AND HAD NOT PROBLEM.

LET ME ADDRESS THIS FIRMLY I KNOW ALL OF MY REPS, EVERY SINGLE ONE OF THEM, I HAPPEN TO KNOW FAHAD PERSONALLY HE IS A HARD WORKING, HONEST INDIVUDUAL WHO IM PROUD TO CALL NOT ONLY A COLLEAGUE BUT ALSO A PERSONAL FRIEND.  HE AND ALL OF MY ASSOCIATES ARE UPSTANDING HARD WORKING PEOPLE, TO INSINUATE HE BLATANTLY LIED IS DEFAMATION, IF THERE WAS ANY INACCURACIES (WHICH IF I KNOW WHO THE POSTER WAS I'D PULL THE RECORDINGS MYSELF) IT WAS JUST THAT, INACCURACIES OR MISCOMMUNICATION.  WE SPEND A TREMENDOUS AMOUNT OF TIME AND MONEY ENSURING OUR AGENTS ARE MOST PROFICIENT IN THEIR RESPECTIVE AREAS OF WORK.  AGAIN AS REFERENCED ABOVE WE ARE 100% COMPLIANT AND RUN A CLEAN HONEST BUSINESS. 

 

TO CONCLUDE MY RESPONSE; LET ME MAKE CLEAR WE ARE AN AMERICAN OWNED, AMERICAN RUN BUSINESS THAT PAYS AMERICAN WAGES WITH ALL THE APPRORIATE BENEIFTS (VACATION, SICK DAYS, OVERTIME, HEALTHCARE, 401K, ETC.) WE PROVIDE AND ESSENTIAL INSURANCE SERVICES TO THE AMERICAN PEOPLE.  I STAND BEHIND MY AGENTS AND OUR ORGANIZATION 100%.  EVERY ONE OF MY COLLEAGUES IS HARD WORKING HONEST LICENSED AGENT WITH ONE GOAL TO PROVIDE FOR THIER FAMILIES BY PROVIDING THE ESSENTIAL INSURANCE SERVICES THE AMERICAN PEOPLE NEED AND DESIRE,  IN THE UTMOST ETHICAL FASHION.
