I requested a hospital accident insurance policy offered through my business with Bank of America be cancelled in April 2008. I called and wrote the company but, they have continued to take the premium until April of 2009. I again requested cancellation and a return of my premiums but, they to date continue to return my money. They say that they have no record of my request but, that is not true. They use horrible business practices and I feel ripped off because the time I have had to put into this process is overwhelming. I am going to check on what my legal recourse is in this matter.

I went through exactly this issue last year (different insurance company). When I tried to cancel the ACH withdrawl, the ins. company said they didn't have any record of making a withdrawl from my account and that they couldn't do anything to stop it. I contacted my bank and got the runaround from numerous employees, both in person and on their 800 number. Their only solution was to close the account (which I'd had for 25 yrs. and was linked to several ACH payments). I persisted and when I threatened to pull my accounts, I was allowed to talk to a branch manager. When I explained the issue, she said the solution was easy (so easy that none of the other 4 employees knew about it). She filled out a form called an ACH dispute. It not only stopped the monthly withdrawls, it credited me for payments made after I had cancelled with the insurance company.

I suggest you take your written cancellation request down to the bank and have them file an ACH dispute. If the employee won't do it, keep going up the ladder until you find someone who knows something about banking. Good luck!
