I received "collection letter" from Afni on 1/12/2007 advising that I owe them $1008.60. It had the "original creditor" as Verizon Communications. I called Verizon first to get information and the representative said they are not finding ANYTHING with my name or the phone number that is the supposed billing number. I proceeded to call Afni and spoke to "Pat Wilson" who advised me that this "debt" is from 1994. That is all the information that he would provide me.

As I was requesting more information about this and also requesting this info to be sent to me via mail, he yelled at me and told me I need to pay. Also, he advised that I need to go to their website and request the information. When you go to their website, you are not able to request the info in writing like I was told.

I wish that I would have looked up Rip Off Report before I called them. I have typed up my letter and am sending it to them today via certified mail with a return receipt.

I have also filed a complaint on the FTC website. The Afni rep also threatened to ruin my credit! I checked my credit report this morning and do not see this creditor on my report. Is there anything else I can do in the meantime?

Follow the advice of the other posters, and do not talk to them. The reason for this is if it ever got to court this could happen. The judge may ask you if you ever spoke, and if you did you would respond "Yes your honor we spoke". The scumbag collection agency now lies and tells the judge, that yes we spoke and we have agreed on a payment plan and here it is in writing. They hold up a forged agreement. This can happen even if you spoke to them about the weather. Believe it or not this would be a binding agreement in court, this does happen. I was warned by my collections attorney regarding a lawsuit not ever to speak to the other party, because of this.

Collection companies sue all the time for debts out side of the statute of limitation. And get default judgements, Why

Because we lets them! We don't claim the sol as a affirmative defence, we fail to appear, respond.

We let them trick, fool and lie on these debts.
mainly, because we don't know our right and the law. and we always wait to review these laws or rights after the summons is served. instead of learning, them when you first get the collection notice.

No it's not right that they came get away with the stuff they do. The FTC and state attorney general will only help or do anything if there are a large amount of complaints. Its going to take one person at a time, to get anything done.

We should hold the people we put in office, more
responsible to write better laws to protect, the people instead of the business.

The FTC shouldn't fine these companies they should take away there license and make there action criminal not civil.

Until that happens each and everyone of us, will continue to get screwed.

sorry I'm not jumping on you john and if I came across as I did, don't mean too. It just sucks that in this country, that companies like these can violate the righs and laws all the time

They can't legally sue-due to being past SOL-but they can try to collect all they want unless a C&D is sent. Then, they'll just sell it to someone else more than likely.
But they fact this company is coming up with so many bogus claims of debt of different origins, is getting scary and annoying.

And I simply wrote them a letter telling them that they were trying to collect something that according to their own records was out of SOL,(they claimed this was a debt incurred in 1993, with Charter Cable. Like most of you, I called Charter, who had no record of any such bill of $23.00.) and that I wouldn't be having any further discussion regarding this matter. Haven't heard from them since.

Another company that seems to be doing this very thing is Paragon Way. The same tact worked with them as well. Good Luck!

This is great information! I really appreciate everyone who has helped so far! Let me ask you guys this: Are you sure I should even respond to them by writing the letter? Does that mean that I am acknowledging this? I know this isn't my collection, but even if it was, it has been 12 years! Isn't that illegal? I didn't get a chance to mail my letter today. It just seems that everything I have been reading today all seems to say about the same thing. It seems we all have an amount due of about $1000 and they are over 10 years old. What do you all think of all this?

Here is some personal information on Pat Wilson from AFNI, Inc. This is the only collection agent with AFINI that could be a Pat Wilson. Unfortunately, I could not find his home phone number like I did for another person. I firmly believe that if these people can call and harass you guys at home and make your life hell then the playing field should be leveled by you having their personal information. If you want to shut this guy up, when he calls you next time recite his full name and address as listed below and see what he says then. I bet his tone of voice changes really quickly.

If you really want them to validate the debt though, you need to send a validation request in writing via Return Receipt Requested. Along with that letter make sure to include the cease communications language. You can find all of that sort of information along with sample letters on the internet. Just Google cease communications letters and it will bring up lots of samples to use (the first one that popped up when I did it was done by Findlaw). You can Google debt validation letters too and that will bring up some good samples as well. Legally, they cannot contact you once they receive either of these letters. You can send them at the same time if you like but make sure you send them RRR.

1. Tell Verizon to put their information in writing to you.

2. Don't talk to the collection agency.

3. Dispute in writing their claim. Send the letter to them certified and return receipt requested. In the letter put the certification number on the letter and do not sign the letter. CA's can forge your signature on documents.

4. It is out of SOL anyway.....
