AGUA MAGIC LLC Hailm El Quali Scammed me Illinois Skokie
His is a formal complaint against Aqua Magic LLC regarding the RainBow Srx (8-1) Vacuum System. This product was purchased on November 10th, 2020 for the amount of $3,461.85 from Halim El Quali. The two receipts given had outlined the terms and conditions on the purchase.
These receipts contained various typographical and grammatical errors that are not complicit with the Illinois Statutes of Limitation for Door-to-Door Sales. Halim had manually recorded my credit card information on a piece of paper since he did not have a remote point-of-sale system immediately available.
Upon the first day of usage, the product appeared to be defective. On November 12th around 9:30PM (CST), I notified Halim of my request to return my original purchase. He then approved of my refund request and confirmed he would pick up the product the following day of November 13th at 5:00PM (CST). Once he arrived at my property to pick up the returned product, Halim had asked the specific details of the defects.
He then utilized the facilities at my household to replicate the defect of the product, which left it completely butchered. Once Halim finished tampering with the product, he said he would need to charge me an additional fee of $150 due to its poor condition, in order for me to receive my refund. I requested that I should not have to pay the $150 fee after he had further corrupted the defective product in which Halim left my property without taking the product with him.
On November 16th, I visited his retail location to drop off the returned product. Upon arrival, there were two police officers investigating the business and a current customer who was receiving poor verbal communication and poor customer service from Halim. Halim charged me a cancellation fee of $550 and did not give me any receipts or confirmation of my requested refund. He said he had changed his mind on the initial $150 fee requested on November 13th and increased to $550. He claimed his point-of-sale system was unable to give him a transaction number for the refund request, even though he had just charged my credit card $550 a few minutes prior.
Upon the Statute of Limitations in Illinois, “a request for refund must be made within three business days”, I have done so. Halim has not sent me any confirmation of my refund and has denied me the right to receiving a full refund amount of $4,011.85 due to his unethical business practices. The product has been available for pickup since November 13th and attempted to drop off on November 16th, and Halim has not given any communication nor willingness that he will receive this returned product nor given any communication of my request to receive my dollars back.
This dispute is deeming that Halim El Quali at Aqua Magic LLC at 3425 Dempster St Suite 100 Skokie, IL 60076 should receive consequences of malpractice, fraud, scam, and unethical business implementation to say the least.
