Aimsurplus Refuses to refund a gun they have in their posession Monroe Ohio

For my birthday, Nov 2019 I decided to purchase a firearm from Aimsurplus. The price point was fine. They shipped the firearm to a local FFL that was lazy and inept. The order was placed on 11/21 with expedited shipping to receive 11/23. The gun was recieved by the FFL who refused to let me come pick it up.

Contacted Aimsurplus and they refused to listen to me, the customer or try to work with me. The FFL returned the pistol Nov 27 and was recieved by Aimsurplus. As of 1/26/2020 they have yet to refund my money and they have the gun in their posession. My bank cannot do anything because they are waiting for this company to respond.

I will never recommend anyone to shop with them. Presently, I am still with out my 400.00+

Aimsurplus sent me the return label and cc'd the ffl. By looking at the shipping tracking, it was received by Aimsurplus

The vendor knows I don't have the gun cause they have it back in their posession.

I know what my next steps are, just playing the long game. Wanted to get them on record here so no one else makes the same mistake I did

One of the interesting things here is that an FFL generally would never return the firearm unless the gun was so substandard that distributing the firearm would be a danger to a reasonable person.  They would never return the firearm for any other reason; they would simply hold the gun for maybe...3 years or so, and then maybe sell it.  And that's where the complication comes into play.  I mean I'm skeptical the FFL actually did return the gun, but if you say they did...?  I can only take your word for it.

The reason the bank hasn't returned your money is because the online vendor thinks you still own the gun; they likely don't have a proper procedure for taking back ownership of firearms returned from the FFL because it doesn't happen all that often.  Accordingly, from the vendor's and bank's perspectives, you still own the gun, so I can see both saying they don't owe funds back to you - and the truth is, that is a reasonable response. 

I would contact the FFL and get the proof the vendor received the gun back, including verification the vendor received the gun, and then deal with your bank or CC company.  This way, you can avoid the vendor.  Best of luck to you....

What reason would be acceptable for keeping my money and the product? I'm very curious to know what you'd deem as reasonable?

At the end of the day they have my money and the gun. I have neither. So what do you think is fair?

"Why did the FFL refuse to let you pick it up?"

The package made a delivery attempt and the janky FFL wasn't there. I contacted him to see what was going on and what would happen. He apologized and said he went to go to the bathroom. Then the UPS updated and it said he received the gun in. I emailed him to see what time he closed. He told me before I could pick up the gun, I had to apologize to him for being frustrated. No way would I apologize to him for his inability to do his job.

Company isn't responding to me or the bank. They've had the pistol back in November it is now January, almost February. There is nothing they can say regarding keeping the money this long. My bank contacted their bank and until they authorize the bank to deduct the funds, they will keep both the pistol and my money.

The FFL wouldn't let you pick it up, the company wouldn't listen to you, and your bank won't do anything.

Why did the FFL refuse to let you pick it up?

What reason is this company giving you for not refunding the money or as you put it wouldn't "work with you"?
