 On this day, 8/24/2009 I called Red Mountain Funding who is the lien holder on a vehicle I purchased through USA auto almost a year ago.The reason for my call is to find out how I can get my car back because on Saturday 22, 2009 it was repod from my work at 10am (which by the way the man who took it went in my work and got irate with a person in the registration area that didn't even know me..) And was wondering what i need to do to get my car back? The woman who answered said I needed to talk to a guy named Al?? I'm guessing he was either the boss or owner. After calling back several times I finally got him at 10am He asked who I was, then proceeded by saying I needed to pay the balance of the car in order to get the car back..He also said I didn't have insurance on the car when I did. I asked, Whats the balance? He said,$7,985 and some odd cents.. I sat in shock considering I was only 2 weeks late and now they want me to pay off the car!! I mentioned that and he told me I haven't contacted them to let them know anything.. Even thought I talk to them there to make my payment 2 weeks prior and they told me they wouldn't take it until I changed my deductible from $1000 to $500 . Well after switching over insurance co. to save money every month it was to late! Now I'm out of a car, getting rides to wrk and my credit is even more a steak! I get paid every two weeks and always make my payments and dont think me or anyone deserves to be treated this way..

You need to review your contract. It sounds like you are leaving something out of your story. Normally car lenders do not repossess if you are just 2 weeks late. You usually have to be a couple months behind. Have you made every other payment on time and in full? If not, then previous partial payments are putting you farther late and adding up more interest.

Additionally, they can dictate what kind of insurance to keep on your car. Look at your contract and see what sort of insurance they mandate for your vehicle. Also when you change insurance, you have to get the new company to contact your lender with all of the policy information.

If they are being unreasonable about anything but the full balance you may be screwed. MOst lenders will let you have the vehicle back if you bring the account current, and pay all the fees from a repo. The vehicle is theirs though, and they can demand full payment. Again, look at your contract and see how a repo is handled on your car. It should spell out the steps.
