Though Albertson's grocery stores has been notified that it is the only one in California to do so, it continues to collect sales tax on distilled water sold in containers marked CA CASH REFUND--which in only placed on containers of beverages sold for human consumption. It continues to collect sales tax on sales of Arrowhead and Sparkletts brand distilled water; saying it must do so because their labels do not have the words, "Intended for Human Consumption" printed on them. They do this in spite of the fact that the Board of Equalization has issued a letter stating, "the California Beverage Container Recycling and Litter Reduction Act, was created to achieve and maintain high recycling rates for the recyclable aluminum, glass and plastic beverage containers Californians use everyday. Therefore, if the CRV labeling is on the distilled water container, the assumption would be that the distilled water is for human consumption. As such, the sales of the distilled water and the related CRV fees would be exempt from tax."
