I am a very active 83 year old white widow who competes in national and international swim competitions with state and national records, paints, dances, does powerlifting, plays the piano and attends live performances of classical and contemporary music or opera about twice a week.

In the interest of meeting a single male with similar interests I met with Rachel of Albuquerque Personal Singles Matchmakers (hereafter ASPM) on April 29, 2017.  After being assured that ASPM could do that I paid $3321.29 to ASPM.  That sum was charged to my Chase VISA card and appeared on that account on April 30, 2017.

Sometime after that ASPM called and offered James as a match.  He was described as retired, educated and a good match for me as he likes to exercise and enjoys music.

On May 23, 2017 I met James for coffee.  I was shocked to learned that he was still married, is black, likes solitude, his only exercise is walking and for music he had attended two live jazz performances during the past year.  James spends most of his time babysitting a grandchild.  

None of this was disclosed to me before I agreed to meet James.  I do not date married men.  ASPM holds itself out as a “Singles” matchmaking service.  I have in the past not dated anyone black. This should have been disclosed to me in advance.   James’ interests and level of activity are no where close to anything that interests me.

Since ASPM failed to perform I contacted it to cancel our agreement and request a full refund.  ASPM refused.

On May 30, 2017 I sent a letter to Chase VISA disputing the $3321.91 charge on the basis that ASPM had not performed its obligations under the agreement.

On July 14, 2017 Chase VISA sent me a letter refusing to reverse the charge saying that ASPM had not promised a refund.  I never claimed that ASPM had promised a refund.

On July 27, 2017 I sent another letter to Chase VISA pointing out, among other things, that I had never claimed that ASPM had promised a refund.  I asked Chase VISA to reconsider its original decision and reverse the charge.

On August 28, 2017 Chase VISA sent a letter to me saying saying the charge was valid because “we are unable to support that a billing error has occurred on your account.”  I never claimed that a billing error had occurred.
