My husband received a call from this agency claiming he owed money for an old AT & T. When I say old I am talking 15 years !! I contacted the attorney and they sent a letter reminding them about the fair practice acts and in FLorida the statute of limitations is 5 years.

AS "verification" Alegis sent per our attorney's request: a sworn affidavit from one of THEIR employees swearing we owe the debt. I responded(we have Pre-Paid legal so its one free letter)In the letter I stated we donot acknowledge the debt and the affidavit sworn and notarized by their employees doesn't suffice. Plus I reminded of my lawyers letter plus COppola V Arrow Financial Services. This statute states that "Information relating to the purchase of a bad debt is proprietary or burdensome" The agency did not provide any contracts, or dates of service. It has not shown up on the credit reports.

I found a great site that gives sample letters for asking for VALIDATATION for bad debt. even if its in the Statute of Limitations. This site is a wealth of information on dealing with collection agencies.***NOte I found on this site that a huge mistake consumers make is in asking the agencies for verification instead of validation.
