Robert and Leonard Alex of Alex Brothers Construction began a home addition in June 2003. In October 2003 they had been paid $45,000 for construction up to that point. On October 10, 2003 Robert demanded more money to finish the job although he had been paid well through the next phase of construction. When I declined to pay him any more and demanded he produce receipts and time records for the work already completed, he refused. He then said if we were not going to pay him more money he could not complete the job. He then refused to continue the work.

Alex Brothers Construction Company, Robert and Leonard Alex were served with a lawsuit in February 2004. The case is pending. They owe the homeowners approximately $25,000. There are approximately 20 past judgements against Alex Brothers Construction Company from Essex County, New Jersey courts.

On Friday October 28, 2005, Robert Alex and Leonard Alex of Alex Brothers Construction appeared in civil court in Essex County, NJ( Newark). Alex Brothers Construction was found liable for violating the NJ consumer fraud act. The company was ordered to pay the plaintiff treble damages in the amount of $61,000 plus attorney's fees of approximately $15,000 dollars. Currently Robert Alex has decleared bankruptcy so there was an automatic stay of personal liability. However, pursuing him persoally is still an option once the banruptcy is setteled. This may clear the way for a criminal prosecution now that a judgement against the company for fraud was entered.
