PMB response

Greetings Gina,

I have attached a writing sample from my blog for your review. I am a degreed writer (B.A., English Literature), with more than 15 years experience writing freelance as well as in-house. I look forward to working with you on my first Freelancer.com project! Thanks for your consideration.

Alice The Poet

My response to this

Great. Here is an article to rewrite. It must pass copyscape and be 400 words long. It has to be 90% unique and score using dupefreepro 10% or under. The keyword is article marketing. Use the keyword in the article 8 times. When you send it back include your paypal address so I can pay you for it. If you do a good job on it I will select you as one of the providers.

thanks

She did a decent job and was awarded the project.

We agreed she would be paid for the sample with the $30 for the 10 originals and 10 rewrites when she finished them.

She did 10 originals and here is here 10 original assignment details

You have a new assignment to accept

Pheori

She sent articles that were in the email not ms docs and they were completely wrong. But before
we looked at them she was assigned the remaining part of our contract for 10 originals and 10 rewrites
At the time of assignment we did not have any rewrites for in place we gave her 5 originals to meet the
$30 project she was awarded. Then we noticed errors in her first 10 and before we could reply she
sent us an email regarding the new assignment, this is what it read

Greetings and thank you for the continued assignments.  This new assignment is certainly different from SEO writing and it is my specialty; which makes it even more exciting.  However, I would have to charge more for these articles.  For my creative writings (in journals and newspapers), I have been paid an average of $150 or more for 500+ words.  Because you are requesting 5 creative articles, I would be willing to do the entire lot for $500, with a 50% milestone payment upfront.  Please let me know if you agree.

Thanks again, for the continued opportunity. AliceThePoet

Here was our response

HAHAHAHAHA!!!

That's a really funny joke about charging us $100.00 for a simple

$2.00 article and if you're not joking, then we will sever our

working relationship with you after you've fulfilled your

contractual obligation with us by completing the articles we assign

you at the agreed-upon rate. If you can truly get that much money

from writing a 500-word article then please go do so somewhere

else.

Anyhow, we have a problem with your recent article submissions...

they aren't what we want at all. I think a few of them are OK, but

I'll have to reject most of them...

None of our articles are meant to be "creative" as they are intended

to build backlinks and to be used for marketing purposes. While we

do write for human readers, we don't expect people to actually read

them. Writing stories and writing in the first person is wholly

unacceptable in this type of article writing.

Client instructions:

"The articles must just be informative and of a general nature and

please do not quote prices or refer to

any websites."

01 OK as is - accepted

02 Uses first-person - rejected

03 Uses first-person and story-telling - rejected

04 OK as is - accepted

05 Mostly OK with some first-person - accepted

with fixes - P.S
cheap

flights from Birmingham to Lanzarote
" is not the

proper usage of the keyword "

cheap

flights to Lanzarote"
and doesn't count. I guess you

accidentally used the wrong keyword.

06 Used the first-person again - rejected

07 Another story we can't use - rejected

08 Storytelling - rejected

09 Storytelling again - rejected

There were also numerous grammatical errors.

So, here's where we stand... you can try to fix the problems with

those 6 rejected articles in order to get paid for them, but if you

don't, we will not use them and you can do with them as you see fit.

We will use and pay you for the remaining 3 articles.

Now, about the contractual obligation... as you will recall, you bid

on this project:

10 SEO Article Writers Needed Urgently

I need 10 American English article writers. The articles will be

keyword based. They will consist of 300-600 words.

This is a test project so bid only $30. This will be for 10 500 word

articles, 10 rewrites. If you write well then I will use you weekly

and you can expect any were from 25-50 articles a week. I have over

100 websites that need articles for marketing weekly.

Requirements

1. Articles must pass Copyscape premium

2. Articles must be free from spelling and grammar errors

3. Articles must make sense

4. Articles must be written in American English

5. Must be able to write and submit 3-5 articles daily

6. Must accept PayPal payments, I won't use escrow

Pay

300 Word Articles $1.25

400 Word Articles $1.50

500 Word Articles $2

600 Word Articles $2.25

Rewrites $1

I will ask you to write a 300 word article to be selected. If you

write it accordingly to what I am asking for in this project you

will be paid for it and selected to finish the rest of the articles

for this project. This is the only way I can test your writing

skills. Please don't bid if you are not willing to write a test

article.

Thank you and Happy Bidding!

------------

So, as you can see, you owe us 7 good articles at our rates as

listed because we've only accepted 3 of the ones you've submitted.

Feel free to email with any questions you might have.

Thanks,

Gina

Here was all of our emails after this and were this has lead.

Just today, I accepted a project that is paying much more than I requested of you for my creative writings and I get to keep the copyrights.  I did not mean to offend you, but I'm glad I made you laugh!  Let me know if you'd like me to rewrite the articles (including #10 that I just submitted) and by what day.

Thanks,
  Alice The Poet

They are due tomorrow.

I just sent over the revised articles #2, 3, 6. 7. and 8.  I hope they meet with your approval.  I will be sending over the revised 9 and 10 in a few hours.  I have a question regarding the original bid which stated..."I will ask you to write a 300 word article to be selected. If you write it accordingly to what I am asking for in this project you will be paid for it and selected to finish the rest of the articles for this project. This is the only way I can test your writing skills. Please don't bid if you are not willing to write a test article."

Even though you want to sever business ties, I was selected to finish the rest of the articles and I am a woman of my word, so I will.  Will I be paid for the original 300 word article and how much?

Thanks,
  Alice The Poet

Our response

Thank you. I'll get these check now.

Thanks
Michele

She responded

I am writing to see if and when I will be paid for the articles and sample completed.

Thank you, Alice The Poet

my response

Pay roll runs from Monday to Sunday and is paid on Mondays the week preceding the end date. I still have yet
to look at the rewritten articles. I am getting to them today so I can get them to the client. You will be paid
today for the sample article since that one was for me personally and then the others on Monday.

Thanks
Michele

I then fell ill and was hospitalized for 1 week. When I returned home she was notified
that all 10 articles were approved and she would be paid. This is the emails I received after that.

I still have not received payment.  What is the status?

I told her the situration and that all of the 10 articles were approved and I would
be paying her for them on Monday but she had to finish the other part of the contract.

Here is all of the emails that happened after that.

on the 10th she said Today is the end of yet another week.  This is my first experience with WV Writing Services and after reviewing a few e-mails I received from this company last week, I am very concerned that I might not receive payment.  Can you tell me an exact day (today), when I will finally be paid for the work that I did (as agreed)?  That way, I can finally close this chapter and move on.  As a writer, this is my business and I must protect my interests.

I responded told her time and agian she would be paid for the articles on Monday
and she said this come Monday

It is obvious that WV Writing Services is ignoring me.  Another Monday (the THIRD) has passed and I still have not received payment as agreed.

I will wait until the close of business tomorrow for my FULL pay to be transferred to my PayPal as agreed.  If not received, I will first file a report with the FBI's internet fraud line.  It is obvious from Gina's e-mail (below), that you never planned to pay me, even though subsequent e-mails from both Michele and Pheori said WV Writing Services would be paying me.

I will also be contacting your State Attorney's office and the Better Business Bureau.  I have copies of all of our correspondence, which I will forward to them along with my complaint.
  Alice The Poet

I replied

OMG wow you are a character. We did say we would pay you right? You did get the emails
regarding the situation of me being hospitalized right? Pheori who is no longer with the company
because she did not submit anyone's work to the clients so it caused a delay in the payments. I sent
everyone an email on Saturday regarding pay and I did payroll on Saturday. Payroll is behind and you
are not scheduled to be paid until this week. I just got the invoiced paid by the client tonight.

Now since you want to talk about the FBI and state attorney and filing complaints we have a written contract
on freelancer for 15 articles and you only did 10 so you are in void of the contract. We are charged $3 for each writer
we choose and unless you write 5 more articles to full fill the contract we will deduct the $3 from your pay for the 10 articles
and we will report the project as incomplete on Freelancer.

Please let me know your choice in closing this matter.

Thank you
Michele Walls

My mistake the contract is for 10 rewrites. So according to the

contract you owe us 10 rewrites.

Until the contract is filled we will not make any payments. If you

want to file a false claim against whoever you

want go ahead but a contract is a contract and you accepted it on

freelancer and you will not be paid until you finish

the whole contract. Just to let you know I have a law degree and I

will tell you if you file false claims you will be sued

for assassination of character on the company and we will seek

restitution for all damages that result in you filing

false reports against my company. Here is a copy of what you agreed

on when you accepted the project on Freelancer.

Now show me an email saying we never said we would pay you or saying

you would be paid before you did the whole contract?

I keep every email too and Pheori never even gave the assumption you

would not be paid. You agreed to this and then after you

submit 10 not so good articles we gave you an assignment that is

exactly the same as the first one but different keywords and you try

to charge us $100 an article hahaha I'm still laughing at that one!

If you could get that you sure as hell would not be writing for

peanuts

would you. You tried to strong arm us and we did not fall for it; I

have all of the emails and we will file a lawsuit if you make any

claims

against us as we did not do anything wrong in this matter. I will be

awaiting your response, you have until the close of tomorrow to

honor

your contract or we will report it as incomplete and will deduct any

finances we occur from you voiding your contract.

She replied with

I completed AND returned ALL of the rewrites which were sent back to me; before the deadline.  Are you now refusing to pay?

I said back

wow you don't get it do you. You did 10 original articles. We rejected a few of them and asked you

to write them according to the instructions you were given. You did and we accepted 10 articles from you.

Our contract was for 10 originals and 10 rewrites. You only done 10 originals. You are not paid for rewriting

and article you originally wrote because you did not do it right the first time. That's common sense. So according

to our contract on Freelancer you owe us 10 rewrites to fill the contract. I did assign you 5 other articles on your

tracker and you refused to do those. So for me to pay you you must finish the job according to the contract.

This is what I am saying so how do you get I'm refusing to pay you from that? You are crazy really. I don't know

how to put it any other way. You agreed to write 10 originals and 10 rewrites for $30

you did 10 originals totaling $20

We are still waiting for the other 10 rewrites. We told you in the email we are expecting you to full fill your end of the

agreement and said to let us know when you are ready to do the rewrites. I will include the sample as one of the rewrites

so you have 9 more to do for us to pay you the $30.

Do you understand this know?

I never said we are not paying you, get that out your head we are waiting for you to finish the job so you can be paid your $30 according to the contract.

If you understand now reply and I will send you 9 more 300 word articles to rewrite and then will check and copyscape them and if they pass I will instantly

send you the $30 as the contract states.

If you opt to not full fill your end of the contract I will deduct from the $20 you earned the $3 we are charged to select you as a winning bid and I will deduct the

money it costs us to upload to freelancer to pay you since I have to pay the first project on Freelancer to be in compliance with their rules.

Thank you
Michele Walls

I did not hear from her for 1 day and then she sends this today

Dear Michele,

I have filed complaints with the FBIs Internet Crime Complaint Center.  I also filed with my local sheriffs department and the Better Business Bureau of Canton Regional & Greater West Virginia.  I included e-mails from you, Michele, and made the complaints in the name of WV Writing Services AND Michele Walls.  I also included the last three e-mails where you verbally abused me and wrote that you have a law degree. If this is not the case, in addition to not honoring our contract, you fradulently misrepresented yourself and WV Writing Services.  Im sure the FBI would be more interested in that than I am. The thing with e-mail is you never know who is on the other side of the screen.  I have a few degrees too, and a lot of life experience.  I also know Im not the only one who has not yet been paid by WV Writing Services.

As far as the rewrites, you yourself admitted that I already did them:

Tuesday, August 31, 2010:  E-mail from Michele Walls, CEO WV Writing Services, Payroll runs from Monday to Sunday and is paid on Mondays the week preceding the end date. I still have yet to look at the REWRITTEN articles. I am getting to them today so I can get them to the client. YOU WILL BE PAID TODAY FOR THE SAMPLE ARTICLE SINCE THAT ONE WAS FOR ME PERSONALLY AND THEN THE OTHERS ON MONDAY.

These complaints can be rescinded as soon as you honor your part of our contract; $30 for the articles, $1.50 for the sample ($31.50).  I wont comment on Freelancer about this incident once this is taken care of if you dont make any negative comments about me and we can part ways.  If not, I will continue to file these complaints with various city, state, county, federal and non-profit agencies and sooner or later, one (or more) will come knocking at your front door.  As I told you in an earlier e-mail, I am a woman of my word.  Im not doing this to strong arm you as you say; I am asking you to honor our contract and will continue to reach out to these agencies because I am a business woman and they were created to stop fraudulent business actions and to protect my interests.

Alice The Poet

I replied back with

Wow you know, I am filing harassing reports in your state of

California too. You never did $30 worth of work. You did $20 and

1.50 for the sample. I see in your

pictures you are old but surely you are not ignorant to think that I

would pay you to do your rewrites on the 10 articles you messed up

and we rejected. It's clear

that you have never done this before. I sit here laughing my but off

that you filed false complaints, you know that is a crime and from

all of your pictures you look like

you have some money. That's money I will seek for restitution and

damages if anything comes from your false reports. LET ME SPELL IT

OUT FOR YOU

I HAVE DONE THIS MANY TIMES BEFORE. YOU AND I HAVE A CONTRACT ON

FREELANCER FOR 10 ORIGINALS AND 10 REWRITES, YOU ONLY WROTE 10

ORIGINALS

THE 10 ORIGINALS YOU SENT WE REJECTED MOST OF CAUSE YOU FAILED TO

READ THE INSTRUCTIONS AND TO GIVE US WHAT WE ASKED FOR. THAT RIGHT

THERE WE COULD HAVE

SAID THANK YOU FOR YOUR TIME AND YOU CAN KEEP YOUR WORK WE CAN NOT

USE YOU CAUSE YOU CAN NOT FOLLOW SIMPLE INSTRUCTIONS. BUT NO I DID

NOT DO THAT, I INSTEAD

TOLD PHEORI TO GIVE YOU ONE MORE CHANCE TO HAVE YOU FIX YOUR

MISTAKES AND RESUBMIT THEM. YOU DID AND I APPROVED 10 ARTICLES. DOES

YOU REWRITING OR FIXING YOUR MISTAKES

IN THE REJECTED ONES COUNT AS A REWRITE EXCUSE MY FRENCH BUT HELL

KNOW. FOR YOU TO EVEN THINK THAT MAKES ME BELIEVE I AM WASTING MY

VALUABLE TIME TYPING THIS MESSAGE CAUSE IT'S OBVIOUS

YOU LACK COMMON AND BASIC KNOWLEDGE. THOUGH AS THE CHRISTIAN I AM I

STILL AM TRYING TO EXPLAIN TO YOU. I OWE YOU FOR 10 ARTICLES AT $2

EACH AND 1 SAMPLE AT 1.50. YOU OWE ME BY CONTRACT

9 ADDITIONAL REWRITES. YOU KEEP REFUSING TO DO THE REWRITES SO IT

COMES TO THIS. I WILL TAKE $3 FROM THE 21.50 AND I CHARGE $40 AN

HOUR FOR CONSULTING AND BY ALL OF THESE NON SENSE EMAILS

BACK AND FORTH YOU ARE TAKING AWAY FROM MY VALUABLE TIME WITH MY

CLIENTS SO FOR WASTING 5 MINUTES OF MY TIME I WILL TAKE OFF WHAT I

OWE YOU ANOTHER   $3.30 FOR 5 MINUTES OF MY TIME.

ALL YOU HAD TO DO WAS FINISH THE CONTRACT YOU AGREED TO ON

FREELANCER AND YOU WOULD HAVE GOTTEN $30. YOU

DID NOT FULL FILL THE CONTRACT

SO YOU VOIDED THE CONTRACT. I AM SENDING VIA FREELANCER

15.20

WHAT I OWE YOU. THEN I AM FILING A BUNCH OF COMPLAINTS

MYSELF AGAINST

YOU.

Yes I bold and made big the text cause she just don't get it. As you can see. So I said

$15.20 received, $16.30 still due.  Until you fully honor our business contract, I will continue to file complaints.  Each time you verbally abuse me, you are actually adding to my list of complaints and evidence.

Please make my final payment of $16.30 immediately, and continue to cyber "stalk" and bully me if you must.
  Alice The Poet

I replied with this

This is a formal request for you not to email me again. I am contacting freelancer right now to discuss

my options for your continuing threats and verbal abuse to cease. DO NOT EMAIL ME OR MY COMPANY AGAIN.

Best of Luck to you
Michele Walls

and she replied with this

Your "law degree" should tell you that I can continue to contact (and file complaints) against you until your debt is paid.  I haven't made any personal attacks as you have done to me;  I'm just legally collecting a rightful debt.  $16.30 remains past due.

This is were we stand. I can not wait until the FBI and whoever she made false
complaints to contact me cause well after you read this you can see she is
a fraud and is trying to black mail me for money she is not owed.

Anyone who knows freelancing knows the business is a performance based business. If you are contracted to do work and you don't do it right then obvious you are
not going to be paid. Her threats and negative publicity are insane as she is.

So if anyone reads anything from Alice the poet regarding I have not paid any of
the writers I hired you know it's not true. WV Writing Services brings in well over
150,000 a year in sales and would not hold a measly $16 from a writer who did work
and deserves it. If I had the time I would file civil charges against her for slander.

If anyone wants to chat regarding this report I am open to conversation and can be reached by email and phone. http://wvwritingservices.com

All buyers beware of Alice the Poet.

Thank you

My Opinion

#8UPDATE EX-employee responds

Thu, October 07, 2010

Alice the Poet. Seriously? The first 10 articles assigned are the common definition of content mill, SEO articles. No one, and I mean no one, would mistake them for "creative writing" pieces. It helps to do a little research before jumping into a new endeavor because if you did research SEO writing, you'd know those articles are SEO, through and through. $500 for Internet content? Insane!

Whether you were hospitalized or on vacation, Michele, you should have had a backup plan as far as paying your writers, such as allowing someone else to handle payments in case of your absence. The writers who work for you are not your friends; it's strictly business and while it's a shame you were hospitalized (for some physical or mental ailment), people still have to get paid but you won't even let your partner touch that business aspect. Boo h*o! I was in the hospital. So what? Take a sedative and move on. No one feels sorry for you. The last two times I was hospitalized, I insisted the ER release me early (a day early after a c-section and the same night after severe, I-could-barely-breathe asthmatic bronchitis during my pregnancy). Why? Because I had important things to do and I had to put my "big girl pants on" and deal with it because the world doesn't stop when I need medical attention; the world doesn't revolve around me.

Back to Alice, who is obviously in wonderland. Rewriting articles in order to fix errors is not an article rewrite. There's a difference and I pray that you are intelligent enough to realize it. When Michele said "REWRITTEN" articles, we all know she meant "revised." Enough said on that subject.

Michele, why do you care what Alice's pictures look like? She's old; she looks like she has a lot of money? Yet another example of your blatant unprofessionalism. And $40/hr for consulting? If your time away from your clients was really that valuable, you would get to the point a lot faster. Also, you changed writing (typing) styles so much in your original complaint, people may think you are a little unstable lol. And I find it shocking that you had the audacity to deduct $3.30 off of her final payment. That is unprofessional and makes you appear as if you lack a little something in the morals department. And $3 for your Freelancer.com fee? This is the risk you take as a high-volume content mill. Only you and small children who have a problem with sportsman-like conduct change the rules as they go so they come out feeling like the winner even if they aren't. If the bulk of your clients got to see this malarkey, I wonder what they'd think? If I were them, I'd be searching for a new supplier who is a little more stable and a little less vindictive.

Alice. It's not cyberstalking when your pictures and info are posted for the world to see on a social-networking site, which I assume is where Michele found it (as she released your MySpace page to the world in your ripoffreport.com complaint. You don't want to the world to see you, keep your page private. Also, if someone asks you to cease a form of contact in regards to collecting an alleged debt, you have to honor that request (if submitted in writing). That's pretty much the standard law nationwide.

Michele, if anyone can spot an "insane" person (as you referred to Alice), another insane person can. If you really do have a law degree, you would know that what Alice is or is not doing is not slander; it's libel. Libel, libel, libel (if she is spreading falsehoods). Do you really have a law degree lol?

You need to take it easy. Alice obviously selected "owner" instead of "ex-employee." The extremely long rant you posted about various tax laws veered far away from the subject at hand and only made you look a little crazy and very unprofessional. As a matter of fact, the more you write, the more unprofessional you seem to sound. For the most part, I skipped over that nonsense.

#8UPDATE Employee

Mon, September 20, 2010

I currently work for Michelle as a freelance writer. I am contracted to write 5 articles a day from Monday to Friday. At no time during my employment with her, have I ever had concerns about my pay. My pay has always come to me weekly, straight into my Paypal account.

I am also do not believe these stories that Michelle has a history of non payment. Having been in the freelance world for approximately 2 years, I always keep a keen eye on my employers and potential clients. Buyers who do not pay, get a reputation on the internet. Freelance writers talk in amongst themselves and I have never seen one bad word about Michelle or her company.

Having read Alice the poet's reviews, I also went looking on Google for bad reviews about Michelle and her company. I used the general web search, the news search and the blog search. There is not one bad report about her.

Also any professional freelance writer will tell you, that if an article gets rejected, you do not get paid for it. All buyers work in this manner, if they did not,  then freelance writers all over the world would be lining up to write bad articles.

Does Alice the Poet have any proof that the rejected articles have been published and used? It is not that hard to find out using a simple program like Copyscape or Dupepro. The lack of information concerning this suggests to me that the articles have never been used.

I also find it rather bizarre that all correspondence is being used under the pen name of Alice the Poet. This is the most strangest and weirdest pen name I have ever heard of. Surely the official letters re lawyers and court cases over 16 dollars, should be sent to Michelle and signed off with a proper name. The fact that they are not, suggests to me that this is an attempt of blackmail or someone who is not as informed about the world of freelancing as she would like to make out.

If you check out Rip-off Report #61601, you will see that there is a history of Michele Wall's inappropriate behavior.  In this case, she did pretty much the same thing to another freelance writer.  The writer's title is, "W V Writing Services W V Wholesalers Rip Off work - Writing Articles - Freelance work - Work for Free! FIRST OFF LET ME SHOW YOU HOW STUPID SHE IS, HER REBUTTAL IS LISTED AS THE OWNER OF THE COMPANY LOL KNOW ALICE YOU ARE NOT THE OWNER OF THE COMPANY YES YOUR TITLE IS ABOUT THE OWNER OF THE COMPANY BUT YOU ARE SUPPOSE TO PUT IN YOUR RELATIONSHIP IN THIS MATTER, THAT WOULD BE FREELANCER. ARE YOU AN EMPLOYEE OF WV WRITING SERVICES, NO BUT SINCE YOU WANT TO CLAIM TO BE YOU NEVER FILLED OUT TAX PAPERS OR A 1099 OR A 1040 SO YOU ARE IN VIOLATION OF THE LAW. I AM REPORTING THAT. I WONDER HOW MANY OTHER PEOPLE HAVE YOU WORKED FOR AS A FREELANCER AND NEVER GAVE THEM YOUR REAL NAME OR TAX INFO, HMM SMELLS LIKE TAX INVASION TO ME. HERE'S A LITTLE HINT, THE IRS IS NOT THE FBI, THEY WILL GO AFTER A PENNY IF IT'S OWED TO THEM.

In the world of income and taxation, corporations, small businesses, and other employers use a variety of forms to record the income earned by an employee or an independent contractor.

Typically, employees of a business receive a W-2 form that lists the income they received during the year. This form also contains deductions taken from that income in the form of federal and state taxes, deferred compensation and social security contributions, to name a few. 1099 forms are used for a number of reasons, though, typically, they are given to independent contractors--also known as "freelancers"--as a record of the income they received from a particular business.

On a 1099 MISC Form, the income earned will be noted, but there will not be any deductions for federal and state income taxes, nor will any deferred compensation, social security, or medical deductions be taken. Since the 1099 recipient is not an employee of the business, the business is obligated only to tender the income to the contractor sans any deductions. This 1099 income is also reported to the Internal Revenue Service so it has the opportunity to track income from freelance workers. The freelancer will be obligated to make his or her own tax deductions and forward such payments to the IRS.

Those who receive 1099 income come from a wide spectrum. Actors, artists, novelists, freelance writers and similar creative artists are generally compensated on a "per job" basis, and are not treated as employees. More and more businesses are bringing in independent contractors to work on a similar "per job" basis, as this helps keep the employer costs down since the employer does not have to pay for such things as health and life insurance, as well as make contributions to retirement plans. After the job is completed, the employer can cut the cord and simply issue the independent contractor a 1099 Form.

What is Self-Employment Tax?

Self-employment tax (SE tax) is a social security and Medicare tax primarily for individuals who work for themselves. It is similar to the social security and Medicare taxes withheld from the pay of most wage earners.

You figure SE tax yourself using Schedule SE (Form 1040). Social security and Medicare taxes of most wage earners are figured by their employers. Also you can deduct half of your SE tax in figuring your adjusted gross income. Wage earners cannot deduct social security and Medicare taxes.

SE tax rate. The self-employment tax rate is 15.3%. The rate consists of two parts: 12.4% for social security (old-age, survivors, and disability insurance) and 2.9% for Medicare (hospital insurance).

Maximum earnings subject to SE tax. Only the first $106,800 of your combined wages, tips, and net earnings in 2009 is subject to any combination of the 12.4% social security part of SE tax, social security tax, or railroad retirement (tier 1) tax.

All your combined wages, tips, and net earnings in 2009 are subject to any combination of the 2.9% Medicare part of SE tax, social security tax, or railroad retirement (tier 1) tax.

Fiscal year filer. If you use a tax year other than the calendar year, you must use the tax rate and maximum earnings limit in effect at the beginning of your tax year. Even if the tax rate or maximum earnings limit changes during your tax year, continue to use the same rate and limit throughout your tax year.

Self-employment tax deduction. You can deduct half of your SE tax in figuring your adjusted gross income.  This deduction only affects your income tax.  It does not affect either your net earnings from self-employment or your SE tax.

How to Pay Self-Employment Tax

To pay SE tax, you must have a social security number (SSN) or an individual taxpayer identification number (ITIN).  This section explains how to:

  • Obtain an SSN or ITIN
  • Pay your SE tax using estimated tax.

Obtaining a Social Security Number. If you never had an SSN, apply for one using Form SS-5, Application for a Social Security Card.  You can get this form at any Social Security office or by calling (800) 772-1213. Download the form from the Social Security Online Web site.

Obtaining an Individual Taxpayer Identification Number. The IRS will issue you an ITIN if you are a nonresident or resident alien and you do not have and are not eligible to get an SSN.  To apply for an ITIN , file Form W-7, Application for IRS Individual Taxpayer Identification Number.

    Estimated Taxes

Federal income tax is a pay-as-you-go tax. You must pay the tax as you earn or receive income during the year. You generally have to make estimated tax payments if you expect to owe tax, including SE tax, of $1,000 or more when you file your return. There are two ways to pay as you go: withholding and estimated taxes.  If you are a self-employed individual and do not have income tax withheld, you must make estimated tax payments.

    Who Must Pay Self-Employment Tax?

You must pay SE tax and file Schedule SE (Form 1040) if either of the following applies.

    • Your net earnings from self-employment (excluding church employee income ) were $400 or more.
    • You had church employee income of $108.28 or more.

Your net earnings from self-employment are based on your earnings subject to SE tax. Most earnings from self-employment are subject to SE tax.  Some earnings from employment (certain earnings that are not subject to social security and Medicare taxes) are subject to SE tax.

If you have earnings subject to SE tax, use Schedule SE to figure your net earnings from self-employment .  Before you figure your net earnings, you generally need to figure your total earnings subject to SE tax.

Note:  The SE tax rules apply no matter how old you are and even if you are already receiving social Security or Medicare.

    Are You Self-Employed?

You are self-employed if any of the following apply to you.

    • You carry on a trade or business as a sole proprietor or an independent contractor.
    • You are a member of a partnership that carries on a trade or business.
    • You are otherwise in business for yourself.

Trade or business. A trade or business is generally an activity carried on for a livelihood or in good faith to make a profit. The facts and circumstances of each case determine whether or not an activity is a trade or business. The regularity of activities and transactions and the production of income are important elements. You do not need to actually make a profit to be in a trade or business as long as you have a profit motive. You do need, however, to make ongoing efforts to further the interests of your business.

Part-time business. You do not have to carry on regular full-time business activities to be self-employed. Having a part-time business in addition to your regular job or business also may be self-employment.

Example. You are employed full time as an engineer at the local plant. You fix televisions and radios during the weekends. You have your own shop, equipment, and tools. You get your customers from advertising and word-of-mouth. You are self-employed as the owner of a part-time repair shop.

Sole proprietor. You are a sole proprietor if you own an unincorporated business by yourself, in most cases. However, if you are the sole member of a domestic limited liability company (LLC), you are not a sole proprietor if you elect to treat the LLC as a corporation. For more information on this election and the tax treatment of a foreign LLC, see Form 8832, Entity Classification Election.

Independent contractor. People such as doctors, dentists, veterinarians, lawyers, accountants, contractors, subcontractors, public stenographers, or auctioneers who are in an independent trade, business, or profession in which they offer their services to the general public are generally independent contractors. However, whether these people are independent contractors or employees depends on the facts in each case. The general rule is that an individual is an independent contractor if the payer has the right to control or direct only the result of the work and not what will be done and how it will be done. The earnings of a person who is working as an independent contractor are subject to SE tax.

You are not an independent contractor if you perform services that can be controlled by an employer (what will be done and how it will be done). This applies even if you are given freedom of action. What matters is that the employer has the legal right to control the details of how the services are performed.

If an employer-employee relationship exists (regardless of what the relationship is called), you are not an independent contractor and your earnings are generally not subject to SE tax. However, your earnings as an employee may be subject to SE tax under other rules discussed in this section.

Estimated tax is the method used to pay tax on income that is not subject to withholding. This includes income from self-employment, interest, dividends, alimony, rent, gains from the sale of assets, prizes and awards. You also may have to pay estimated tax if the amount of income tax being withheld from your salary, pension, or other income is not enough.

Estimated tax is used to pay both income tax and self-employment tax, as well as other taxes and amounts reported on your tax return. If you do not pay enough through withholding or estimated tax payments, you may be charged a penalty. If you do not pay enough by the due date of each payment period you may be charged a penalty even if you are due a refund when you file your tax return.

      Who Must Pay Estimated Tax

If you had a tax liability for 2008, you may have to pay estimated tax for 2009.

      General Rule
You must pay estimated tax for 2009 if both of the following apply.

      1. You expect to owe at least $1,000 in tax for 2009 after subtracting your withholding and credits.
      2. You expect your withholding and credits to be less than the smaller of;

        • 90% of the tax to be shown on your 2009 tax return, or
        • 100% of the tax shown on your 2008 tax return. Your 2008 tax return must cover all 12 months.
If you are self-employed you must pay Estimated Taxes
This applies even if you also have a full-time or part-time job and your employer withholds taxes from your wages. Estimated tax is the method used to pay tax on income that is not subject to withholding. If you dont make quarterly payments you can be penalized for underpayment at the end of the tax year.

Another perspective

Though I have no first-hand knowledge of this particular dispute, I feel that I must at least provide an alternative perspective as to the trustworthiness of the company in question. As a freelance writer who has written more than a thousand articles for WV Writing services over the course of more than a year, I believe that this particular incident is a rarity for writers who freelance for Michele. Having communicated with a number of those writers, I know that their experience has been as rewarding as my own.

It is unfortunate that these type of incidents do occasionally occur in the freelance world, and are often the result of miscommunication, misunderstanding, and mutual mistrust. Regardless of the factors that have led to Alice and Michele's current conflict, however, the fact that they have yet to reach an acceptable accord should not be seen as any kind of indication that Michele's company is anything but honest and straightforward.

WV Writing Services has consistently and reliably paid me for every single article that I have ever written for the company, and has done so in a fair and timely manner. It is a rare thing indeed when payment is delayed, and even then such delays are invariably the result of medical and other emergencies.

Hopefully, Alice and Michele can reach accommodation soon. In the meantime, I would urge any freelance writer who considers contracting for work with WV Writing Services to not allow their opinions of the company to be adversely affected by this incident. WV Writing remains a writer-friendly and trustworthy partner for freelance scribes everywhere.

Freelancers Beware! WV Writing Services Scam and Verbally Abusive CEO, Michele Walls

#8REBUTTAL Owner of company

Fri, September 17, 2010

Freelancers Beware! WV Writing Services Scam and Verbally Abusive CEO, Michele Walls #1. This client pays peanuts. I decided to take the peanuts as a step into the seo writing world. This was one of two projects that I won as a new freelance writer on Freelancer.com. Thank goodness the first project that I completed was a dream project; earning me 10 stars; the highest rating! (Excellent writing skills! Alice the Poet turned my words into a professional sounding text, with the artistic touch only a poet could impart to it. Highly recommended!) You can see it for yourself on my profile on the site. #2. This client, Michele Walls, CEO of WV Writing Services, is verbally abusive. #3. She lies. Even on Freelancer.com she lied saying that the project was incomplete and that she didn't pay me. She did this so that I would not be able to make a comment or rate her as a client. I guess she didnt realize that Freelancer.com can confirm that she paid me $15.20 (she paid through them). Even though it was less than half of what she agreed to pay . I completed one 400 world sample article, ten 500 word articles, and ALL of the rewrites she returned. They were all completed and turned in by the project deadline of August 28, 2010. She set the deadline. Michele Walls has shown you herself, in her report that she lies: Tuesday, August 31, 2010: E-mail from Michele Walls, CEO WV Writing Services, Payroll runs from Monday to Sunday and is paid on Mondays the week preceding the end date. [No payment was made on August 31, 2010 and no payment was made on Monday, September 6, Tuesday, September 7, Wednesday, September 8, Thursday, September 9, Friday, September 10...] Note, how she includes my message about rescinding the complaints directly after her message dated August 31, 2010. My message was actually sent over two weeks later, on September 15, 2010. Michele has not only left out quite a bit in her report, she has also added some things: She sent articles that were in the email not ms docs, [Yes I did. WV Writing Services never requested ms docs! The request for ms docs is not in the original posting on Freelancer.com and its not in ANY of the e-mails I received from Michele Walls or WV Writing Services. Also she never complained about the way they were sent until today in this rip-off report; almost four weeks later.] Michele also wrote in her report that, At the time of assignment we did not have any rewrites for in place we gave her 5 originals to meet the $30 project she was awarded. [She never mentioned she was sending anything in place of rewrites. That idea just wont fly. If that was the case clients could substitute 2,000 case studies in place of 250 word blogs!] #4. Early red flag: During my first week, I received an e-mail from Michele apologizing for the "late payroll." Since I was a new writer, Im sure this was for the benefit of the other writers, but alarm bells began to go off. The second week I received more excuses. #6. Some of the things said and done by Michele Walls, CEO of WV Writing Services; You are crazy really, I see in your pictures you are old, [Yes, she looked me up like a cyberstalker! And whats wrong with old? I wonder what the AARP would feel about that? Im also wondering what Freelancer.com feels about her serious Code of Conduct violations.] You look like you have money, [So does that mean I dont get my peanuts, Michele?!] EXCUSE MY FRENCH BUT HELL KNOW, [Yes, this is how she spells no. She told me she has a law degree. Her alma mater would be so proud.] If I wasnt a Christian, [I dont care if she worships a head of lettuce, I just want my peanuts!] YOU LACK COMMON AND BASIC KNOWLEDGE [Wow, really professional, Michele.] $40/hr for consulting I WILL TAKE OFF WHAT I OWE YOU ANOTHER $3.30 FOR 5 MINUTES OF MY TIME... [Of course none of these deductions were mentioned in the original agreement.  The fact remains, I didnt receive any payment until after I started filing complaints. I think Michele hoped that because it was such a small amount, that I wouldnt pursue it, but right is right. BTW, $16.30 of that $150,000 shes talking about belongs to me. I wonder how much more of it belongs to other freelance writers. Peanuts I know, but my peanuts and I worked hard for them. By the way, Ive been freelancing for over fifteen years; I know a scammer when I smell one. Get your money up front and your head examined if you would even consider working with WV Writing Services or Michele Walls, CEO!

The retainer for my attorney is $1,500.  You could be legally liable for that amount, plus the $16.30, any court costs, interest and collection fees.  Tomorrow (Thursday, September 16, 2010) by close of business, if I have not received my $16.30, I will file complaints with the Better Business Bureau in Scottsdale and the Arizona State Attorney's office.  I have been insulted by you for the last time.  By the way, the FBI has requested your IP Address from me.  When I forward it to them, I can either tell them that you have finally honored our contract and paid me in full or I can tell them that you have not.  It's up to you.
