Complaint Review: All Clean Home Care

This company is a telemarketing business to clean the home of Orange County, California

On or around December 6, 2001. When I was first hired as independent contractor as carpet and window cleaner, the business owner, Sam Martin and dispatcher, Crystal agreed that I have hearing disability and understood I am American with Disability Acts (A.D.A.) compliant person. I understand that I had to use my own equipment and buy my own cleaning solution supplies. They had replace dispatcher from Crystal to James and James becomes operation manager.

On or around March 30, 2001, James took the company radio away from em for unknow reason. For the last few days, I showed up for the work and James kept telling me that he don't have anything for me to do and I looked at his desk and saw the job listing and it showed there are lots of job to do. He said he will call me if the jobs comes up, I said ok, I also asked him about the radio, he said you will have to talk Sam about it. I told him to have Sam to call me at home, James said Sam never call any technicians at home. I also called the office and left the message to have Sam to call me. Ever since, I have never get his phone calls and I have wrote a short letter and it is very important that Sam should call me ASAP and mailed to him with certified mail. But never had any phone call from Sam.

In my past, I have never pay deposit for the radio, pay for the radio cost weekly and uniform cost, but this company do take it out of my paychecks. I want my money back in full.

I pay for the cleaning solution to clean the carpets, I have few places that I have cleaned the carpets that have taken out of my checks of Calls Back, I still want that pay back. As of today, they still owing me $1265.49

I planning on file small claim court against Sam and his company, All I am asking the court is get all my money back.

On April 3, 2001, I have send a certified mail in demand to pay me $2,319.40 within 30 days or I will filed small claim at the court. The certified mail was returned marked Refused. I have filed small claim court and sued Sam Martin, DBA: All Clean Home Care on May 8, 2001. For the amount of $2,319.40.

On the court day, June 7, Sam did not showed up at the court and the judge have awarded me for the total amount of $2,319.40 plus court cost of $40.00. I have received a letter from the court Notice of Entry of Judgment on June 18, 2001. Stating that the defendant, All Clean Home Care shall pay me $2,359.40.

It past 30 days, I never had received any payment from All Clean Home Care and I returned the court to Execution, which it cost me $7.00 and hand it over to the Sheriff dept. for Levy and it cost me $85.00. I have told instruction how to get there and where to get the checks from that office and told them to be in no later than 9:00 am. They told me it would take 45 days to get my money.

On or around September 18, 2001, I have never get anything or report from the Sheriff Dept. I went back to the court and trying to find out what's going on. Then I learned that Sheriff Deputy R. Martin # 6164 went to the location on 7/18/01 at 14:15 (2:15 PM) and it is way too late of the day to visit. I know James made a very false statement to the deputy. The accounts not paid by mail, they are left on James' desk on premises to be picked by the account holder. That got me very upset and I can't afford to pay another $85.00 to continue the service for the sheriff.

Today, I have never heard and receive my money from All Clean Home Care or Orange County Sheriff's Department.

What a major rip off company!
