Jose Gallardo with Alliance One contacted me on 11/13/2006 stating that he was collecting an alleged debt for GMAC in the amount of $11,129.00. This alleged account was previously pulled fom collections by another collection agency in March 2006 as a direct violation of the Servicemembers Civil Relief Act - at which time they stated I only owed $9,000.00. This was supposedly the charged off amount of a vehicle that was repossessed by GMAC during the time that I was activated with the MS Army National Guard and deployed in Iraq. I was never allowed due process on this note, which had been bankrupted by the guarantor during my activation time with the military.

Jose Gallardo never advised me of my rights under the FDCPA, commonly known by collectors as the mini-miranda, during the entire conversation. When I asked Jose Gallardo for validation of the alleged debt (the actual charged-off amount, the date of the charge-off, and the court order giving GMAC the right to reposses the vehicle and charge off the balance to me) he stated that he did not have that information. Further more, when I requested the address and contact phone number for GMAC, he stated that he did not have that information either.

Did they know that you were sent to active duty? Do you have proof that they knew if they did?
