Allied Concrete Material Ripped me off by not paying to have my car repaired after concrete debris hit car Manvel Texas

Allied Concrete refuses to pay to have my auto repaired after their truck dislodged dried concrete which struck the hood and windshield of my car on June 18,2003.

I motioned the driver to move to the shoulder to inform him what he had done to my car. He was very cooperative and apologetic. The driver gave me the Safety Manager's name and phone number to contact.

It took 2 attempts contacting Allied Concrete by phone to discuss the incident. They said i needed to complete their general liability form and submit it to them. I returned their form along with photographs and an estimate of damage. They refuse to pay since i can't produce witnesses. I explained to Allied that maintaining control of my car at a rate of 55-65mph during rush hour traffic took precedence over trying to determine which passing car could have witnessed this incident and at the same time get the driver to pull over. Doing all this simultaneously is impossible.

Allied is telling so sorry, too bad, you pay, not our fault. I told them that it is their responsibility to put their trucks on the road in a safe manner and by not adhering to safety precautions they cause incidents such as this. If they would enforce or implement safety measures this conversation would not be necessary.

I want them to pay and accept responsibility to what they did to my car.
