My Wife and Daughter were involved in a Auto Accident while on Vacation in 1991. They were at a stop light and were plowed into by a 18 year old driver going at a estimated speed of 50 mph. I read the police report and was amazed they didn't drug test or anything.

They were only on a 6 lane road three lanes on each side. After waging a good fight and case I was able to settle with them on my wifes behalf but not my daughters. I was lied to and said I could not do anything until she turns 18.

Well I call Allstate up when she turned 18 this year. I was told that the "Statue of Limitation had Expired" and therefore had no case. Those Liars. They said the claims people back then have since retired or died.

Well, I am begining to see Florida as a Cracker Jack State!Now the person who look at the claim over the years and said my daughter never went to any Doctors for treatment so she must not be hurt anyways. Bull, She was afraid to even ride in a car for almost three years and was carried off in a Ambulance for memories after the wreck.

She has refused Medical treatment By choice. I used to drive a Ambulance for a Company In Long Beach, Ca Before ParaMedics and a Collision of a estimated speed of greater than 50 MPH struck from behind and No skid marks usually resulted in some major trauma down the road. Period, Always, forever, Pain.

Suddenly I was lied to and she said rudely blow it out your a*s cause were not paying one penny. What a company. I had to fight every day with them for my wifes claim and I mean everyday.

I was in California and they were in Fort Meyers.So ALLSTATE heres to your untruthfull evil Employees in Fort Meyers Florida.

They deserve a bonus because they ripped me another hole by a big fat lie. My daughter by rights, should have been compensated the same as my wife. You want to know something? It really was not that much because I only took the policy limits which was only the minimum required.Jerks You need to pay up as a obligation.

I trusted your Claims adjusters or I would have settle back then. I bet not one person from Allstate even gives a s--t. So split the settlement that rightfully should have been hers creeps.

I am an insurance claims professional with many years' experience. The statute of limitations in Florida is 4 years from the date of the accident, or in your daughter's case, 4 years from the date she reaches majority (age 18). Feel free to confirm this with a personal injury attorney.

The Statute of Limitations has not run on your daughter's claim. The liability for this accident appears clear on the other party, if you were rear-ended. From your description, you were stopped when struck. However, there are a few additional issues here: Florida does have a permanency statute. This means that a "permanent" injury must occur before a settlement is made.

Setting aside the statute of limitations issue, you may have difficulty overcoming the permanency question if your daughter sought no medical treatment as a result of the accident. You also mention that you were paid policy limits. If the responsible party only had minimal limits for bodily injury (say $10,000 per person, $20,000 per accident) with Allstate, and Allstate has already paid you and your wife the policy limits, there is no additional money left for your daughter's claim.
