We had a loan with another mortgage company before we were sold to GMAC. While with the former company, we became behind in our payments and ended up in foreclosure. But at the meeting we were able to catch up our payments and keep our home. The mortgage company sold us right after that to GMAC and they didn't correct our paymeny history to show we were current. GMAC started foreclosing. We called and sent court documents proving we were current. They ignored us. We hired a local lawyer. He sent documents and they ignored him. So we filed bankruptcy, chapter 13. As soon as we came out of bankruptcy, GMAC began foreclosing again on what we had just paid twice for, first time with the other company and now through bankruptcy. Our lawyer tried to negotiate with them. At first they said they would do a moderation program but then resended.

They upped our payment from $1342.00 to $2100.00 a month and added escrow. We originally had a fixed contract. We called and asked them how could they legally change a contract and was told they could do anything they wanted to protect their property. We managed to pay one payment of $2100.00, but had to go back to our regular payment. GMAC started foreclosing again, saying we were behind because we sent the orginal payment.

We filed bankruptcy again to stop the foreclosure but at the end of this one, GMAC began to foreclose again on the original amount we had paid the former company. Three times we paid for the same debt. GMAC didn't listen to us or our lawyer. This time our lawyer said he would fight it for us but he needed 2500.00 to start. We didn't have it, so they took our home. Now we received $749.00 from the National Mortgage Settlement. We were not behind on our payment. We paid for the same debt from the former company three times. GMAC would not listen and ignored documents to prove we did not owe. They took our home we had lived in for thirty years. We received $749.00. There is no justice in America. How can a company just come in and steal your home? Plus our credit is ruined over this. It is all so unfair. I have contacted other lawyers to try and sue, but then they all want money we don't have.
