We have had trouble with AMC from the beginning and did not do our homework prior to going with them. Our fault! However, we sold our home in Florida and the paperwork was to be completed on May 15th. I elected to have May's payment taken from the payoff, which in hindsight was not the best decision. However, the home did close on June 1, 2007, after a delay due to both us and the buyer's being out of the Florida area and having to overnight papers to the title company. When the title company sent the payoff to AMC, they threatened to return it since it did not include 4 days additional interest (due to interest changing on June 1). The title company convinced them to let us send an additional check for $471 plus change for the difference. We sent it overnight mail and they signed for it, accepted it, etc.

Now today we get another call and AMC says we are still delinquent because even though they have the check, it has not been posted and won't be for 5-7 days so we should expect calls daily. AMC seems to be doing their best to sabatoge the entire deal.

Additional things AMC has done: they were to notify us when two years were up so we could be sure we did not end up in an ARM. They never did and we were not able to get anyone who would help us out --

The original mortgage was to be for 6.40%; when we signed the papers it had jumped of over 7%. Their comment: oh, that's nothing to worry about. (Again, we should have backed out but we had been hit by 4 hurricanes and were caught in a financial bind.)

And, it was just brought to my attention that under the Fair Lending Agreement where race is marked, they had us as African/Americans. That in itself does not bother us, except we are caucasian, and did they do this to receive undue benefits?

I am a mortgage broker (NOT for Ameriquest ) but on my own.

The 'race' box is actually required by HUD so the gov can keep track of minorities getting loans. This way they can see that they are NOT being taken advantgage of. The loan officer HAS to put in race, or he wont get the loan .

You can refuse to reply, but the loan officer has to put it in. I bet your loan was negotiated over the phone, or he s/he ticked the wrong box. It has nothing to do with the actual loan itself.

As for ameriquest STALLING the cashing of the check as a back door way to rake in more interest, its against the law. They cannot charge you a nickels worth of more interest once they got it in their hands, unless they made a reasonalbe attempt to clear the check and it bounced .

A judge wont buy the 'we need time to clear the check' routine where it opens up a can of worms to hold it for 30 or 60 days, making daily interest in the process.

Why didnt ameriquest give their banking info to title so it could be WIRED into their account anyway?


In the end, go to a scientist , and get a futuristic proceedure that enables you to ERASE every single memory you ever had of Ameriquest, and move on with your life.
