America's Servicing Company Problems with Payment Posting Ripoff Frederick Maryland

We refinanced our home in 2004. Well after several months with Select Portfolio Servicing we received a letter in November saying that the last time that Select Portfolio Servicing would be receiving any of our payments would be November 16, 2004. We never received anything from America's Servicing Company, until December a lady from them called and asked to speak to me. Well, I work crazy hours in the winter due to my job. So my wife said she would handle the call, the lady was adament on speaking with me.

So, I called her a couple of days later and she just wanted to confirm the mailing address, work phone, home phone, physical address, just account information, etc. She then said that it could take a few months before we would receive a coupon/statement. So my wife was making copies of the transferrable letter that we had received from Select Portfolio Servicing stating the change. By month three we still didn't have the coupon to make the payment, I then called America's Servicing Company and the lady said that it would take a few days, but I would be receiving a coupon. I then asked her for the account number so that we could write it on the check, and she provided me with that. Our February payment was now due, so we included the account number on the check and mailed it like we always do. It is now February 13th, and on the 11th our house payment is late. So on the 11th I receive a call from a gentleman stating that they haven't received the payment. I then tell him when it was mailed, he then told me to give it a few more days and then stop payment on that check and mail another one. Well, I'm sorry, but if they haven't received the first one, the sure as H*** won't receive the second one either.

After reading all of these posts I am now worried that they might try to stick it to me and my family. I wanted their website so that I could just pull up the account online and view the history, etc, but when I did a search online for the company's web address it directed me to you guys. My wife and I already have bankruptcy from 10 years ago that we still have to contend with on our credit, we don't need a foreclosure as well. I am contemplating re-financing again to try and get a different lender. Worried in GA....

I am an employee of America's Servicing Company in the imbound collections dept. I agree w/few things that have been brought up and disagree w/the rest. I do agree that we have a harsh outbound collections campaign. I have talked to some people that have never been late ever - but are being called on the 4th of each month for their payment. Others have received up to 6 calls a day. However, you all signed the mortgage which states very clearly that your pymt is due on the 1st, considered late on the 2nd. We take that very seriously. Of course you do have a grace period, but we have the right to call to make sure that pymt is on the way. We do not try to rip you off. Not every mortgage company offers repayment plans to their customers. I have helped so many people save their houses and feel great about that. I know a lot of ASC employees that really care about helping people get back on their feet. I also know some who don't really care and do not go the extra mile. You will find those kinds of people working everywhere. Mortgage companies, stores, schools, banks to name a few. Face it some people just aren't nice. That's life. Anyway, we aquire thousands of loans each month and it takes a while for them to board on the system. That's why you have a 60 day respa period.
