Our loan was sold to America's Servicing Company in December 2003 by Option One. Our mortgage payment included funds to be reserved on an escorw account for our property tax payment.

On March 18, 2004 a deduction of $1,216.33 was drawn from our escrow account for April 10, 2004 property tax due to the Los Angeles County Tax Collectors. According to ASC a payment was sent in a bulk check covering various tax parcel account that included our property but they have not provided copies of the cancelled check and the list of properties covering this payment to the Los Angeles County Tax Collectors.

As of this date November 3, 2004 our property tax for April 10, 2004 still remain unpaid. When we received our first notice from the Los Angeles County Tax Collector we faxed a copy to the tax department with instruction that someone contact us to discuss this matter.

Patrick Himes was the person who call responded and advice us that he would be investigating this matter. Twice he has told us that this payment would be sent out overnight express. He has lied, lied and continues to lie. We have been unable to reach a supervisior or any other person with authority to resolve my issue. We are now forced to pay this bill with penalties and concerning filing a small claims lawsuit. What will happen in when Dec 10th taxes are due!!!
