I was forced into arbitration with AAA for a discrimination, retaliation and harassment lawsuit against my emplotyer Tenet Healthcare. Tenet Healthcare hownever failed to comply to their own Fair Treatment Policy steps 1-4 but forced me into step 5. I not only had clear evidence and witnesses testimony to support my claims, Tenet Healthcare was caught falsifying evidence and tampering with witnesses during the arbitration proceedings. The arbitrator allowed 4 hours of the arbitration process to stop so that the defense could prove a document was valid. After wasting 4 hours of my attorneys time and my time, the arbitrator acknowledged the evidence was fraudulant and could not be used. But, the arbitrator

then turned a blind eye to the actual true evidence, testimony and allowed unethical behavior of the defense during the entire proceeding. The defense was allowed to do anything they wanted while the arbitrator refused to allow my attorney from entering evidence and asking relevant questions to the defense because the arbitrator believed the information was "personal". However, this same arbitrator allowed evidence, not provided during discovery by the defense, to be admitted into the proceedings only to  further abuse, humiliate and belittle me. The evidence was regarding domestic violence that my minor children and myself survived over 10 years prior. The arbitrator forced each line to be read while I was forced

to acknowledge that happened in my past. My attorney objected and I pleaded to stop as memories that I had surpressed were forced into a setting especially since in front of me were the people who had called me useless, worthless and no body likes. Tenet Healthcare HR Dir acknowledged that it was said to me but because I didn't have it in writing the arbitrator ignored Tenet Healthcare testimony and made his own assumptions about me. The arbitrator indicated in his "award" that I had it made up my mind when I met my director of Tenet Healthcare that it would be difficult to work with her. There was no mention of this during the proceedings, in evidence or testimony. The arbitrator spoke alone with the

defense. This was apparent in the defense briefs which  indicated what the arbitrator knew what to be true before the arbitrator had even made his written award. The defense attorney knew about personal details of the arbitrators life and asked about the arbitrators daughter that was in medical school. In the award, the arbitrator stated that Tenet Healthcare did not do a good job with reviews and the interaction process to accommodate my disability but there is nothing in the law that they have to do a good job. However, the ADA laws states otherwise. The arbitrator made no reference to the laws or any cases my attorney detailed in her briefs. The law, evidence, fraud and testimony were a waste of time. The

process is bias to AAA clients for repeat business. No accountability for the law to be upheld and for justice to be served. The "nonprofit" arbitrator was paid over $66k by Tenet Healthcare for his services. From the conversations I heard between the defense attorney and himself, Mr John (Jay) McCauley is currently paying for his daughter's medical school. I'm sure Tenet Healthcare is paying the way. Well, at least a chuck was paid off from this proceeding. However, I am left broken and traumatized by this whole experience. Hopefully Mr McCauleys daughter cures cancer so any of this can make sense.
