Our loan was transferred to Americas Servicing Company (ASC) effective October 1, 2005. I pay all of my bills electronically through Wachovia. Had my first problem with my payment being posted to my account in a timely fashion and had a three-way conversation with America's Servicing Co and Wachovia. ASC reversed my late payment, or so I thought.

Next problem I had was that I accidently paid my other mortage payment to ASC. Forgive me but my loan being sold over and over gets confusing. So I called ASC and explained to them what had happened. The very nice rep. reassured me that it happened all the time and they would send my money back to me. After three weeks and no money and close to my next payment due date, I called back to ASC and was told that they payment had been applied to my account. Asked her if I could pay the difference then and she said that would be fine. Next thing I know, I get a letter saying that I have so much time to to pay so much money or lose my home. They have yet to apply my last payment which cleared my account before my grace period and continue to add late payment to my account.

I am contacting a lawyer. After all the BS I have heard about this company, I think it would be in my best interest. By the way, we are subprime and my husband is hispanic. Target?
