AmeriCredit Auto Financial Service Finally Gave In Internet
I will make this short and sweet. My second car loan was through Americredit at the interest rate of 32%. I was paying $598 a month for a Chrysler that was falling apart. I had traded in a 2004 Chrysler when I still got hooked to this company. I was TEN DAYS late with my payment and they would start calling me at work. This woman harassed me and said they have the right to call as often as they want, where they want and there is NOTHING I can do about it. She proceeded to call me a LOSER and that I was late because I could not handle money and it was my fault. This woman got me so upset she brought me to tears. I hung up on her and then called back and complained. Fat lot of good it did. If you are TEN SECONDS late with your payment, these people start calling you every hour on the hour and I am not exaggerating. They used to fill up my answering machine at home and then transfer to calling at work. Finally I DEMANDED that they stop calling my office which they did only because they HAD to. Maybe it was because I filed a complaint with the attorney general's office in regards to this. In addition to the extra high interest rate, they charge $10 A DAY for each day you are late and they keep track of this and expect you to pay it. After two years of this harassment and because my nerves were shot because of them, I finally said "screw it" and I let them reposess the car. What a relief this was when the phone calls finally stopped! Now I have another car, with another loan at a NORMAL interest rate and everything is fine. This company really needs to have some business ethics instilled in them. I hope whoever else they are harassing now, files a complaint with the attorney general.

I agree with what everyone says and that I was bad, the high interest rate was MY FAULT, the fact that I may have paid late WAS MY FAULT. What I should have done when I was at the car dealers was prevent this. What happened was at first they told me my payment would be $25 more than the 2004 I was trading in and that was affordable, but when he put the contract in front of me a couple days later, the payment turned out to be $150 more. The total I would have paid for this 2006 automobile was over forty thousand dollars which I think anyone would say was a little high. I should have walked away at that time and would have had they not already disposed of my car. So maybe my complaint should be with the dealer for if it weren't for them, I wouldn't have been stuck with a high car payment that I couldn't afford. I did manage to pay on it for two years and would have continued but you don't know how stressfull it can be to have people calling you all the time and verbally assaulting you on the phone. There was no reason for this woman to take personal stabs at me (true or otherwise) when I was only ten days late. I was doing the best that I could AND I was paying, even if I may have been late, they still got their payment usually within 30 days. If I had to do this all over again, I never would have signed that contract. Lesson learned that hard way.

Its great you don't use your real name. You and your family would be horrendously embarrassed if you did because its quite obvious you don't have a clue what you're talking about. But what would we expect...one sub-prime thinker agreeing with another sub-prime thinker! Its bad enough just being a sub-prime borrower but combining that with sub-prime thinking is the typical example of financial irresponsibility for a lifetime.
Collections efforts are TURNED ON by a borrower when they don't make their payments on time. But its easy to understand that fact is beyond your level of financial common sense...just like your idiotic, stupid statement about contacting an attorney when the deadbeat gets repoed and a deficiency is owed.
Whatever it takes, whether its medication, professional help or some type of intervention...please seek it out. "Thinking" like that tells the world you are a danger. Oh wait a minute, you're in Florida. Perhaps the Baker Act will cover cases such as yours.

Having Americredit contact you at work is illegal per the FDCPA (Federal Debt Collector Practices Act), but you have to let them know that your supervisor does not approve of such calls. In fact, what you should have done is to tell them that you will only correspond with Americredit in writing.
This is something that you should discuss with an attorney about, especially now that your 2004 Chrysler has been repossessed and Americredit could come back at you with a lawsuit for the difference between what the car sold for and your loan amount. From reading your Rip-off Report I think you have been harassed enough by Americredit and I feel Americredit does not know the wording and the spirit of the FDCPA.
I am glad you have another car with a decent interest rate now, and that's great - you are trying to reestablish your credit especially in this tough economy. Unfortunately, Americredit's repossession will make a dent on your credit report but not as much of a dent compared to a real estate foreclosure or a bankruptcy.

They kept their end of the contract and you reneged on yours. They called you on it. You, in turn, went crying to the Attorney General.

Americredit is a "Sub-Prime" lender. However, for you to get a 32% Interest rate you must have had some very serious credit issues. I have had Americredit in the past and had an interest rate right around single digits. I don't recall ever receiving a call from them, and I am sure that I was late a couple of times by a few days..so so much for your they will call you if you are 10 seconds late. So I really wonder if there is more to this story than you are saying.
Your loan agreement stated you would make your payment on a specific date. It also said that you would be charged late fees if you pay after a certain date. Now you are suprised that they would call you when you are 10 days late wondering when you would make the payment? You are also surprised that they were holding you to your agreement. Talk about "business ethics"..where is yours in fullfilling the legal agreement you made with them? If you didn't like the 32% interest why did you agree to it, you could have turned around and walked out and look for another lender.
If you think that "everything is fine now", you are going to have a very bad wake-up call. Having the car reposessed does not relieve you of the loan. They will sell the car at auction, for a fraction of the value. YOU are still responsible for the balance of the loan. If you don't pay it they will turn you over to collections and have a collection account on your credit report. If you still don't pay it they will eventually file a suit against you for the deficency balance. They will get a judgment, as any claims of the high interest rate or calls won't really matter. Once they have a judgment they may be able to Garnish your wages or attach your bank accounts.
