In March 2008 we purchased a vehicle. The vehicle was financed by Americredit. At the time of finance, my wife was a member of the US Army as a Reserve member. She was assigned to Ft. Sam Houston for training.
On September 25, 2008 she graduated from her training at Ft. Sam Houston and her status was changed to Active Reserve to Reserve. Due to the conditions of the economy, we decided that she would discuss the possibility of joining the Army as an Active Soldier.
On October 10, 2008 my wife was sworn into the US Army as an active member. My wife was assigned to Ft. Campbell, KY. Upon arriving to Ft. Campbell, we contacted all of our creditors about the Civil Service Members Relief Act. At the request of these creditors, a letter with the copy of the orders were faxed to these companies requesting loans and credit cards agreements reflect the quidelines under the federal law.
Americredit was the only creditor to adjust the auto line to be in line with the law. It read the law myself and from what I understand Americredit is in violation of this law.
I have contacted Americredit and the representatives treat you like you are worthless abd refuse to adjust our loan.
I have been unemployed since October 3rd and Americredit refuses to work with us on any of the payments. They will defer two payments if I agree to pay a $300.00 fee.
The customer service representatives will call you as many as 9 times per days starting the first day that you are late. I have tried to make payments over the phone and demand a $10 service fee and waive that fee. One representative told me to pay $10 less than the monthly payment in order to make the fee payment.
Americredit is a company that harrasses customers and refuse to work in these touch times.

first off, thank you, to your wife for serving our country!

There may be a misunderstanding with this issue. The SCRA or SSCRA (soldiers & sailors civil relief act) is an act submitted for Active Duty soldiers only. Not an "active member". you stated your wife was assigned to Fort Campbell, KY. This act protect soldiers who are currently fighting in iraq overseas. If your wife is not overseas then this act is not for her.

If she is, however, ACF will need verified paperwork from army stating that is she currently in active duty (overseas). Once all paperwork is complete, ACF automatically lowers any APR you are currently at to 6%. Which obviously drops the monthly payments and adjusts the loan. Of course this only works once again if she is in "active duty" and especially if she is on the car loan as well. If it is just your name on the loan then this will not effect you personal account.

As far as the deferments go. Unfortunately there are costs to extend your loan with a deferment. ACF is not obligated to give deferments (((it is a privilege))). No where in the contract it states your are titled to a deferment. There are fees determining the state of your contract, how many late fees you have on the acct already, so and so forth. You can always ask if they can adjust the fee or not (((never hurts to try))).

Hope this can bring a little more closure to you. Because really this is not a ripoff if your wife is not overseas on ACTIVE DUTY serving in Iraq. It is just a mere misunderstanding of the act (sscra).
