I am a Ssg in the United States Army. In 1999 my ex-wife went into agreement with Americredit to finance a 1999 Kia Sephia. At the time I was stationed in Hawaii. In December of 2002 I recieved a call stating that my ex-wife had totalled the vehicle. In January of 2003 I got a divorce. In May of 2003 I was re-married and I was sent to Korea for a year. my current wife proceeded to handle my fianances while I was gone and discovered that Americredit was showing on my credit report. mind you I never co signed for the car. It was showing that I owed them between eight and nine thousand dollars the amount changed with each credit company. By mid June 2003 my wife and I made payment arrangements in the amount of two-hundred and fifthy dollars a month because when i returned fron Korea we were panning on buying a house. Mid October 2003 we ran into some financial difficulties and proceeded to call Americredit to make some arrangements so that we could keep up the payments well they did'nt comply. I returned home from korea in May of 2004 and Americredit was still on my credit report but none of the payments that were made was showing. So we wasnt able to but a house. In January 2005 I was sent to Iraq for Operation Iraqi Freedom 3. During the time that I was gone my wife being the smart woman that she is went online to Carfax and put in the Vehicle Identifaction Number for the 1999 Kia Sephia and never in a million years would we have thought that the information we found out would be what it was. In the facts about the Kia it stated that it had been in an accident in Dec.2002 but it also stated that it was not total lossed, that is was still being driven, that the mileage was still going up and as if that isn't enough Carfax tried to sell the car back to us hmmmm. Mind you Americredit never sent us any information on the car all they did was came after us for payments. My thing is if the car is still drivable then why was we told it was totaled and why are they coming after us for payments. We have a vehicle now that we got through a friend and we still have six months left to pay on it but last week the engine died which left us with out a vehicle. My wife and I are struggling to get to were we need to go especially Myself being that I am military. We went to try and get another vehicle and low and behold we can not because Americredit is showing on my credit report as a Charge Off and that makes it to where no one will deal with us. This has been on going for four years now with Americredit and as of 3/23/06 I still haven't recieved any information from Americredit. I left out the fact that while I was stationed in Korea that Jag (Judge Advocate General) attempted to reach Americredit as well and they recieved no responese also. Americredit is a Ripoff if there is anyone that is willing to help us please, please contact us. As for this site you guys are a blessing because we were at our wits end and my wife just happened to be online today and discovered this site. Thank you and please feel free to contact us and please help us out if you can it will be greatly appreciated....

I can certainly relate to your situation and it hits real close to home in our case. My husband is in the AIR NATIONAL GUARD and was stationed in Kuwait for Operation Iraqi Freedom in 2004 and 2005. HE tried for months to get Americredit loansharks to reduce his interest rate under the SCRA. He sent his orders by fax, and by mail and even sent them certified and still these loansharks refused to abide by them.

After arriving in Kuwait, I was continually harrassed by this company and they even refused to accept my power or attorney. Finally he got the JAG to send them confirmation of his orders and they refused again until he kept sending them certified and we got a signature, so they couldnt play the old famous WE NEVER GOT THEM.
This company is known for losing , yeah right, documents and payments. There is nothing that this company has not done to people and there is nothing that they wont do either. It is a shame and disgrace how they have the nerve to use the word America in their name. THEY dont now or have they ever respected the men and women in uniform. What do you expect from a bunch of greedy loansharks who are nothing but liars and thieves.

Our car was put in charge-off while he was still deployed and we were not notified of this either.
Then it was repoed with no notification and also they stole my social security card and wallet out of the vehicle and also stole several other items that belonged to my daughter. They even broke a trophy she had won in a beauty pageant. What a bunch of lowlifes and some people have the nerve to get on this website and defend this scum. that is a disgrace too.

AMERICREDIT does exactly as they please but you still need to document all phone calls and correspondence with them. the ATTORNEY GENERAL AND BBB JUST BLOW YOU OFF WHEN YOU REPORT TO THEM, But we still continue to do it. go to the news media and give them some much deserved publicity and also write to the President of the United States. I am still waiting on my response from his office with our dilemma we have had with them. It is a disgrace how military people are treated and how the government allows it to go on. I even sent copies of several rip-off reports to the attorney general but it didnt do any good. Somehow, the right person is going to come along and help the consumers who have been wronged by this company. Americredit knows how far they can go and they call it legal. It is legally stealing from consumers and they know it. The rules change daily and it doenst matter who you speak to, you will get a different answer. I have heard of some pretty low companies but I have to say this is the worst one yet. The dealerships get a kick-back by using these lowlifes and they have no morals either. I tell everyone I know if they go into a dealership and have any blemish on their credit, be sure to tell the dealership that they refuse to use Americredit. You will be sorry if you do.

Hope things will start looking up for you and your wife and I wish you both the best.
WE are waiting for a class action lawsuit and would love to see this loanshark company shut down for good.

Even with lowlifes like Americredit
we can still say GOD BLESS THE USA

SSg Clarence L and wife,

I happened to stumble upon this site by doing my own investigating of Americredit and Cavalry Portfolio who bought the charged off account from Americredit. They usually will leave messages and say This is CPS you need to call us immidiatly.

We called them because we had children and thought it was child protective services. Turned up it was the collection agency. Anyway they hassle you for a while then you won't hear from them for a while. Then you'll get a lawsuit in the mail from them. Then if you don't defend yourself by showing up in court and bringing your records with you and showing the judge. They'll rule against you.

So please show up in court when the time comes. That was in Oct. 2003. Then in March 10,2006 they garnished our bank account. I don't know how they got our account number. They debitted our account for 18,000.00. The Charge off balance was 9,000. How it doubles I don't know. Maybe that's why they wait for a few years. They couldn't take that so they took what they could all that was there. $870.00 my husbands direct deposit pay.

For the rest of the month we didn't deposit anymore money in the account. We would cash his check at Safeway. It got to where Safeway didn't want to cash such a large check, too risky they said. Not even the bank that the check was drawn on would cash it for free they wanted a large fee.

This went on for three weeks. What is a blessing, is we had just refinanced our house one month before this and we did some home improvements and I'm glad all the checks cleared before this happened.

Two days later the garnishment happened. All the checks for the flooring and countertops cleared. They didn't warn us. They sent legal papers arrived the day after saying they were going to garnish us. I'm so glad the flooring got paid because I would hate to even imagine what could have happend then. Anyway there was a piece of paper at the end of the legal paper they wanted us to fill out and return it to the court. But it's almost like they didn't want you to see it. Because they sent a copy of the old lawsuit of 2003 and the garnishment and ther exemption form. The exemption form, is the important one.

I called our attorney that we had hired and asked about this form. He said make sure you list what you want exempted from garnishment. Like your house, your household goods. Your vehicles how many people in your family(very important because the more people, the less they can take). Any money from unemployment, social services, social security they can't take these.

So, I have two adopted daughters who we get adoption support from the state ($938.00) per month. Well I listed all that. The attorney who was suing us called and said, Can you prove you get this from the state and that it goes into the account? I sent him the proof. The next day he calls back and says, Good news we're releasing your money back. Can you pay $150.00 per month?

Well that happened last week and today tuesday it was back into our account. I faxed him a letter saying yes go ahead and garnish us but you caused us alot of damage. We defaulted on some payday loans and cancelled our medical insurance because you took our money. So if any thing happens to us before May they will be getting all our medical bills.

What did they gain by doing this, nothing. I let them know I wrote to attorney generals office, govenor's office, three major television stations, this site. Now while looking at the law firm that sued us in the computer yesterday I saw my complaint right there on the second page of the attorney who sued us. And it looks pretty bad for them. So your complaint is guess where? In the company you listed Americredit site to haunt them forever.

Take care and good luck sargent and wife. Sorry our military personnel have to go through stuff like this. They already made the ultimate sacrafice by keeping us safe. God Bless you all.

Hilda
