Ameriquest Mortgage, AMC Mortgage Services Ripoff LIARS & CHEATS! Ameriquest's appraisor appraised my house as a 3 bedroom and it is a 2 bedroom house, hence my appraisal was higher that the actual value. Orange California

I refinaced with Ameriquest Mortgage, Sterling Heights, MI office via Robyn Ross (she has since left) in November, 2004. Going over my loan papers just in the past couple months,I discovered that the appraisal was fraudulent, as the appraisor listed my house as a 3 bedroom (not a 2 bedroom which it actually is) and compared it to 3 BEDROOM HOMES in this area so it appraised for more than it is actually worth. My equity is practically gone in my home.

My Title Affidavit, which has my signature on it, was notarized by a Scott Ward, Notary Public, State of Michigan, County of Oakland; HOWEVER, I NEVER signed this document before a notary at all!! AND, this Scott Ward never witnessed my signature. Also, on another loan document "Scott Ward signed a statement that said I personally appeared and he notarized my signature. This is a LIE!

There are other discrepancies in my loan papers. I also cannot find my Good Faith Estimate either. Being stressed and pressured at the time by Robyn Ross saying that I would never get another company to finance me because of my credit bureau report score, I went ahead and obtained the loan, but did not get any actual HUD Statement until I received my monies via courier after I supposedly "closed" on this loan.

All correspondence was done over the phone and by the courier who delivered and picked up papers. There was never an actual "closing" that I can remember. Also, there was a check for over $3,000 made out in my name, but I NEVER ASKED for any cash out on this loan. The original amount was supposed to be about $100,000, but this extra amount made the loan jump to $103,000. I only wanted to pay off some debts I had at the time.

In the meantime, I was forced to take an early retirement because of stress related illnesses (I'm not a hypochondriac) and only receive my pension once per month on the 25th in the amount of $1346.00. Needless to say, I cannot keep up with these mortgage payments.

I contacted Ameriquest and they gave me a listing of businesses to call and to ask for money: Salvation Army, Catholic Services, etc., like I would really do that! And,they said they could not give me a lower rate. My rate right now is 8.85 percent, adjustable, with a prepayment. I did not know about the prepayment until really looking at the papers, which I should have done before initialing anything, because Robyn Ross told me there was not a prepayment and I could refinance in 3 for 4 months to lower my interest payment. She also told me that Ameriquest pays for the appraisal and I found out that I paid for it ($400) by them putting it into my loan. She deceived me all the way through the whole process.

To make a long story short... I am now facing Foreclosure. I get phone calls from these people at AMC once or twice a day, even on Sundays! I missed making the July 1, 2005 payment and am now late 16 days late on my August 1, 2005 payment. I received a letter dated August 8, 2005. At that point I was 38 days late on my payments. The letter stated that if I did not make a payment in the amount of $1690.00 by September 1, 2005, that they (AMC) would use their option of "sale".

Do yourselves a favor and DO NOT do business with this company: Ameriquest Mortgage a/k/a AMC Mortgage Services and let everyone you know about these liars and thieves.

Also, make sure you read every single line in loan papers or mortgage papers and make sure you understand everything you are signing. Make sure you read the "fine print" items also and save yourself a lot of heartache.

Does anyone think I have a case for a lawsuit against the Notary Public or Ameriquest Mortgage?

Most of this is your fault, but AMERIQUEST does suck

You should've read the loan docs before signing!!!! You're fault entirely. As far as the Notary, do some research and see if he has other complaints of the same nature against him. Otherwise, it's your word against his.

Now, if that supposed '3rd bedroom' has a closet, it is considered a 3rd bedroom. Believe it or not, even though it could never be a bedroom, if there's a closet there, it's a bedroom according to the appraisers.

It sounds like you are now in over your head anyway. Try to sell the house and get away before they repo it.
