My husband and I refinanced with ameriquest 3 years ago september. After the hurricanes of 2004 in florida our area was affected by all three, we fell behind in our mortgage by 1 month. We asked for help from them as far as letting us make the missed payment at a later date or add some money to other payments until it was paid.

We were told no way and sent a letter telling us the loan was in default and would be foreclosed on we were able after things got back to normal make the missing payment. Well things were fine until january 2005 when we received a letter once again from them now stating we were under forced insurance and starting in march our payments would now be 871.79 instead of 519.25.

We had been sending escrow money to them in 2004. We were told this large payment was paying for 2004,2005 & 2006. We told them we paid for 2004 they said the xtra money send to them went towards principle because they did not know what to do with it although i was mailed a letter from them january 2004 to increase payments for insurance. So now we are again 1 month behind it is hard for us to pay such a large amount.

We are unable to get insurance on our own due to the age of our house(built in 1930). Well now we are selling our home and now they say we our a prepayment penalty of 20% AND 6 months of interest which is more than 10,000. We were told when we signed the papers we were told there was a 2 year prepayment at 2%.so we asked when this was up I person said september 16 and I said september 24. And now they know our house is being sold because if the payoff request and we are harrasted several times daily and they try and scare us with all kinds of threats from ruining credit to foreclosure our being 1 month late.

I'm not sure how they can ask for an additional 10,000 and call us several times a day. We have tried to work with them and they say they are unable to help at all. They have told us to borrow the money or call local churches to ask for their help. I just want to sell this house and NEVER NEVER do business with them again!

If anyone can help with these issues or give me advice we would be grateful.
