Charter Communications (Spectrum Cable) I disputed the alleged account in writing via email and certified mail with Charter Communications (Spectrum Cable) pursuant to California's Rosenthal Fair Debt Collection Practices Act Civil Code 1788 on 11-6-2021, Amsher never responded, I had filed a written Notice to Cancel Service with Charter on July 1, 2020 and Ms. Monica Hernandez in their Executive Offices, I changed to an internet-based service provider at half the monthly cost, the cable modem, router, channel changers were all returned to Charter because Charter refused to come to my house to pick-up their equipment, and now they want to bill me for 3 extra months on service after the July 1, 2020 cancel date?
Charter assigned the alleged account to Amsher and now Amsher has reported the account as delinquent in collections? All Californians should check out California law Civil Code 1788 Rosenthal Fair Debt Collections Practices Act allows up to a $1000 "statutory charge" and California Civil Code 1785.1 thru 1785.31 that allows up to $5000 in damages for FALSE credit bureau reporting. I did!

I have already answered your alleged "'facts 1 and 2" in a prior rebuttle but I am restating agains. 1) I have attached a copy for Charter (Spectrums) advertising for "no contracts," and 2) Show me the California law regarding your comments for the consumer notice to terminate service requires a payment? None exist.

I have read your rebuttle arguement and you are incorrect as usual for your fact 1 and 2.
Fact 1 rebuttle - this account did not have an existing balance and I actually had a credit balance, and
Fact 2 rebuttle - show me the California law for your allged "cycle for service" and "existing balance" arguement. I have a copy of Charter (Spectrum's) "no contract."
No contract means no contract including your Fact #1 and #2.

I have read your comments and you obviously do not understand California law dealing with service contracts. In my case, I did not have a service contract, it wasmonth to month service but I will provide the following for service contracts in California. A consumer has a right to TERMINATE a service contractat anytime period. It does not matter if the consumer has an outstanding balance, the issue is the service contract.
In my case a "Written Notice" was provided to a specific person in the Executive Office with whom I had been dealing with for aseveral months due to bad service by Charter Communications subsidiary "Spectrum." Spectrum's service uses "hard cables" in the home, bad service, old technology vs new technology using "WiFi" by their competitors, the "WiFi" based monthly service cost is less than half for "Spectrum," Spectrum did not offer 'WiFi" based service in my area, Specture was not and is not competitive, and terminating the "Spectrum" service was a good business decision. I had been using Charter dating back to the 1990's when Mr. John Malone operated TCI communications, evolved to "Adelphia," then to "Spectrum," THEN TO "Charter."
California has many flaws but when it comes to consumer rights, all that consumers are obligated to do under the law is to provide a "Written Notice" to end service. Plain and simple. In fact many service providers now advertise "no service contract" because California law prohibits restrictions imposed by the "old" service contracts.
Now, Amsher was put on written notice pursuant to California's Rosenthal fair debt Collection Practices Act CCP1788 to validate the alleged account on 11-6-2021 in response to their ldemand letter dated 10-14-2021, Amsher failed to respond in writing to the 11-6-2021 dispute letter that restricts any credit bureau reporting during the dispute period, and 'Rosenthal" has a trigger for imposing up to a $1000 "statutory penalty" for the violation and California civil Code 1788.1 thru 1785.36 provides for up to $5000 for damages resulting from "incorrect" credit bureau reporting. These are specifica California laws.
If collection agencies want to do business in California they must be licensed per Finance Code 100000 and follow all of California's credit laws.

You neglected to point out some factors... FACT- You cannot cancel service with an existing PAST DUE BALANCE. That is for service rendered and DOES NOT VANISH because you claim to cancel. FACT- Cable-TV is a SUBSCRIPTION SERVICE. You are NOT charged for usage!!!!! If the service is available to you, you are on the hook for its monthly charge....UNLESS....service unavailability is the fault of the cable company. Getting temporarily disconnected because you failed to pay your bill does not fall into this category because that wasn't caused by the cable company but by you.
FACT-Cancelling after the cycle date means YOU ARE ON THE HOOK for that month's service. Sounds like you were TWO MONTHS PAST DUE and you were hard disconnected. Simply turning in your boxes DOES NOT CANCEL SERVICE...the PAST DUE BALANCE NEEDS TO BE PAID! NO, I don't work for them or any cable company.
