Fatality Fest 2013 contacted several vendors in Montana to attend their event in Billings being held in August. The space rental for the vendors signing up early was $205.99 and required online payment through Eventbrite.com. People were registering as early as May 2013.

There was lack of communication right from the start after registering. Packets for the vendors were delayed, incorrect emails being sent out for the event. End of July the packets were still not finished and then the main coordinator was in a serious auto wreck, everyone was notified via Facebook announcement.

Inquiries started coming in to their business page about the event being canceled, what steps to take for refunds, and who to contact.

We were publicly told that the owner would get back with everyone once she was back in the office after her recovery.

Announcement was posted on August 6th via Facebook. Here is the important quote of that post "Our ticket holders will have a choice; hold onto their tickets for next year, or we can reimburse their ticket fee. Our vendors will be handled on a case by case basis and hopefully they will be able to reschedule for the next show."

The website's original policies stated the normal "In the event that there is a cancellation...90 days to get a refund" It is now December 2013 and there are a few vendors that still have not received their full refund. Many emails later, no vendor can inquire on their facebook page because they delete the posts, phone calls not returned, and very sketchy excuses as to why the money has not been refunded. One of them being that since the event was postponed and not "actually" canceled, that she didn't have to refund anyone their money. So in this statement itself, it says that she gets to pick and choose, playing favorites with vendors and disregarding some.

The Owner has started another entertainment company, Bloodybombshell entertainment. Fatality fest's name has changed to Fatality films.

Updates, information correction of original complaint

Here is the LAST email sent that explains in detail the differences between ADA Management, Fatality Fest and Fatality Films. As I can not remove anything in the original complaint, this is the update.
The only company and person in question at the time were ADA Management and Andrea Albin, with whom most of the  email correspondences were sent to about the refunds.
 
 
I just wanted to send a brief follow up now that you have been paid. This will be my final communication with you aside from a rebuttal that we will be filing on Ripoff Report. 
 
While I appreciate the consistent feedback that was offered, as well as your patience, I need to address the inaccuracies in what was reported on the website. Unfortunately until today I did not take the opportunity to read your report in detail- but my legal team has advised me to reach out to you regarding some things that I would request be changed immediately. If you are unable to change them, L.G. (Full name removed, unsure if it will cause more anger in the issues already), listed on this email, will be addressing the issue with you. She is an immediate contact to our lawyer , his assistant, and will be taking over to repair our Google results. 
 
I want to once again apologize that your full payment was not received until today. As a business owner, we have been struggling to pick up the pieces after several unfortunate incidents and we are now in the process of rebuilding after a loss. As another business owner, I'm sure that you can respect that we did what we could to make payment- even if you felt as if we weren't being entirely truthful. I'm sure you can also respect that as an outsider to my company and professional dealings, I was not obligated to explain myself beyond what I did. 
 
The following inaccuracies are noted:
 
  1. Fatality Films is NOT the same thing as Fatality Fest. These are two separate entities- Fatality Fest was an event put on by ADA Management Group, while Fatality Films is my independent horror film production company that is co-owned by another individual. Fatality Films was a sponsor for the event. This needs to be updated as my business partner was not involved with the event, and they are two completely separate things. We can prove this through business licensing and incorporation papers, all of which are readily available. 
  2. The screen shot of Fatality Films includes copyrighted material for the film DARLING CLEMENTINES. The owner of this copyright, the director/creator of the film, has requested that this be removed since he was also not associated with the event in question. 
  3. Both my home address, as well as Katie's cell phone number, are listed on the website. ADA Management Group had originally been a home-based business and this information is readily available, but my home address does not belong on a Ripoff Report. Neither does Katie's cell phone number, regardless of it being on the Fatality Fest website. 
  4. The Owner has started another entertainment company, Bloodybombshell entertainment. Fatality fest's name has changed to Fatality films— this entire statement is false and untrue. Bloody Bombshell Entertainment had been formed prior to this incident, and the name did NOT change. They are, again, separate entities. Bloody Bombshell Entertainment was also not involved and this can be proved with financial records, all belonging to ADA Management Group.
I will be filing a rebuttal on the site, but we request that you change information if possible. I might have done the same thing in your position, but I cannot stand by certain aspects being posted that are not true. 
 
We are also in the process of reviewing your complaint to the Better Business Bureau.

In July of 2013, due to personal and professional circumstances, Fatality Fest-Billings was postponed. The event has been rescheduled for September of 2014 at the Holiday Inn Grand Hotel and Convention Center. There is a contract and payment already in place. The contract was revised by management and announced in October of 2013.

The event was not canceled.

In November of 2013, ADA Management Group closed its doors. A few vendors were unfortunately overlooked and management from the company have been working to repay the vendors. While it has taken awhile, no money was stolen and some form of payment, if not all, has been made.

Though we understand the reason for this complaint, there are many inaccuracies in this report. This report has been turned over to our legal team due to the misinformation involved. Per their advice, we have filed this rebuttal.

1. ADA Management Group was the sole company responsible for the financial dealings of Fatality Fest-Billings. The company was acquired by another entertainment firm in late summer 2013, but has sinced closed its doors. Bloody Bombshell Entertainment and Fatality Films, though owned by a mutual party, are completely separate entities. Their only involvement with Fatality Fest 2013 was sponsorship and support.

2. To further explain, Fatality Fest did not become Fatality Films. Fatality Films is an independent production company that was a sponsor and supporter of Fatality Fest. Though the names are similar, the companies are completely separate from one another. Fatality Films is not financially responsible for any business dealings with Fatality Fest.

3. To reitterate, the event was not canceled. It was postponed.

4. The writer of this report failed to mention that in addition to offering refunds, Fatality Fest offered other incentives to vendors who had registered for the event. For the event in 2014, vendors who had registered for the 2013 show would receive a free 10x10 booth (worth $250), four (4) VIP tickets (worth $800), and free advertisement in our programs. We also offered social media interaction with our 20,000+ reach across Twitter and Facebook. We have retained emails that were sent to every vendor regarding this offer.

5. We had mentioned to several vendors who were upset about refunds that we were not required by law to issue a refund, but would be doing so. In the vendor agreement, signed and dated by all vendors, postponement is not a cause for refund. This misinterpretation of an outside conversation with another vendor is heresay by the author.

6. Twenty one vendors registered for the event and only four were overlooked. As of February 24th, two have been paid in full and the other two will continue receiving payments toward their balance. All of our vendors who have been awaiting payment, including the author of this report, received some form of payment from us in December of 2013. The author of this report failed to mention that prior to writing this article, she received a check in the amount of $100 toward her $205.99 balance. This check was received by her, and cashed, on December 23rd, 2013. Financial records from Wells Frago prove this. This report was filed after several emails, sent over the Christmas holiday, went unanswered. Our offices were closed due to Christmas and we responded immediately after.

7. We have apologized excessively and feel horrible about the situation. The final payment was received by the author on February 24th, 2014. This issue has been resolved.
