Dear Friends and Readers of the Rip Off Report:

I am sure you heard the expression,  I AM FROM THE GOVERNMENT AND I AM HERE TO HELP YOU.  Everyone thinks this only applies to the IRS, but it actually applies to all levels of Government.

Keeping that in mind, here is our Nightmare, after we went to State Government for Help.

My husband and I are 2 innocent senior citizens, who moved to Maine a bit over 2 years ago.  With hindsight being 20/20, we wish we never set foot in this State.

We know now, how very hostile to the citizen, this State Government can be.

We made the mistake of trusting in a negligent Real Estate Agent.  This agent caused us great financial loss, emotional and physical distress.  Her failure to disclose negative information about a house and town caused us great harm.  She also allowed the sellers to leave the home in dirty and damaged condition.

She and her broker were of no help to us, denied everything and got their commission for the harm they caused to us.  She was supposed to be our buyers agent.

With no money to pay a Lawyer, we did the next best thing.  That was to file a complaint with the Maine Real Estate Commission.

We foolishly thought we would get some level of justice.  WRONG. WRONG AND WRONG AGAIN.  Despite our lenghty complaint, evidence, exhibits and rebuttal, the Real Estate Commission Deputy Director, Jeffrey Hill sent to our home on 2/5/18, an investigator named Bruce Osborne.

Osborne was on the side of the agent from the Start.  He would not allow us to speak.  He only wanted us to concur with what the agent said and did not care about our side.  We felt and told him that this "interview" was more like an "iterrogation".

Well, Osborne wrongfully dismissed our valid complaint.  He did this with willful malice against us.

One needs to understand, that such Government agencies are made up of the people in the same profession as those the public is complaining about.  The members of the REC and Committee are either current real estate agents or brokers or have been.

Thus, YOU ARE NOT SINGING TO CHOIR.

When, we got the dismissal, which was full of minimizations, and gross distortions of the truth, we are livid with justified rage.

I called Anne Head, Commissioner of the State of Maine and also emailed her.  I thought she would be able to help us since her office governs over the Professional Licensing Boards and the Real Estate Commission.

When I spoke with her, on 5/10/18, she seemed to be kind and caring.  I told her the whole painful story.

Ms. Head Suggested that we:

1.) File a complaint against the REC and Bruce Osborne and Human Resources.

2.) Get an Appeal and Review of both the complaint against the REC and the original complaint against the agent and her broker.

She even said that she would assist us in BOTH situations.

Here is what happened:

She assigned this to her assistant, Melissa Hinkley, who also seemed nice.

We wrote up the complaint and sent it to Anne Head's office.  Ms. Hinkley assigned it to 2 ladies in Human Resources.  Our complaint consisted of 23 typed pages along with exhibits A - H.

In late June, we met with 2 ladies, and spent 90 minutes discussing the complaint.  Believe, me I now know what PTSD (Post Tramatic Stress Disorder) feels like.  It was a re-telling our the horrible experiences with the Real Estate Commission and the outright lies that were written up in the wrongful dismissal of our valid claim against the agent.

Both women seemed nice, but at the end of the 90 minutes, told us that ALL IS CONFIDENTIAL AND WE WOULD ONLY GET A LETTER STATING THEIR INVESTIGATION WAS CONCLUDED AND NOT KNOW THE RESULT OF ANY DECISION.

Talk about a Closed System!!!  Again, I remind the readers of this report that it is the taxpayers of the State of Maine, who pay the Union Wages of these Government Workers.

THERE NEEDS TO BE MORE TRANSPARENCY HERE.

We will never know if any disiplinary action was ever taken against the REC or Bruce Osborne.  Most likely a slap on the wrist and all is forgiven and forgotten.

Wait, it gets much worse.

True to her word, Anne Head and Melissa Hinkley sent our complaint and the entire file, with the original complaint against the agent, to the Attorney General's Office.

I spent weeks trying to find out to whom in the AG office had our file.  I got no information nor help from the AG staff.

I had asked Ms. Hinkley if she and Ms. Head read my complaint against the REC.  Ms. Hinkley replied,  NO, WE DO NOT GET INVOLVED IN PERSONNEL MATTERS.

I guess, they simply do not care.

On 7/2/18, I got a call from Andrew Black, and Assistant Attorney General in the AG office.  I thought that he was calling to arrange a meeting to discuss this matter and give us a Review and Appeal.

AGAIN, I WAS WRONG, WRONG, WRONG.

Black was rude and hostile from the start.  He said that THIS WHOLE FILE WAS JUST DUMPED ON MY DESK TODAY - meaning July 2nd.

He made it quite clear that his office would REPRESENT THE REAL ESTATE COMMISSION SHOULD WE FILE ANY LEGAL ACTION.

I was dumbfounded.  I asked him about our APPEAL AND REVIEW.  He practically yelled into the phone,  WELL YOU ARE NOT GOING TO GET ONE.

I tried to explain myself, but this rude man kept talking over me.  He threatened 3 times to TERMINATE THE CONVERSATION.  Then he hung up on me.

I was upset, but got no further help from the AG office.

Upon help from an aide in the governor's office, I found out, on July 6, that Andrew Black Dismissed our entire Complaint on July 5th.  With July 4th being a holdiay, there is no way that he could have read and understood over 125 pages of material plus exhibits and rules of law.

We got the phony dismissal letter July 9th.

We did file a complaint against Andrew Black, that that was another CONFIDENTIAL farce.

WE NOW KNOW THE FOLLOWING:

Commissioner, Anne Head's intention was to get us to file this complaint against the REC, so the Attorney General's Office would know all we know and have the entire file, in their possession should we DARE TO TAKE ANY LEGAL ACTION.

After all, Andrew Black made it quite clear that HIS OFFICE'S MISSION IS TO PROTECT THE REAL ESTATE COMMISSION.

With all, we suffered, we now suffer more - knowing that Anne Head and the Commissioner's Office fooled us into giving up our knowledge.

THIS IS LIKE GIVING YOUR BATTLE PLANS TO THE ENEMY.  ONE CANNOT WIN A WAR IF DOING THAT.

This is our story.  We are just two mal-treated senior citizens and no one cares.  We lost all our credibility with any lawyer and cannot even win a claim with the real estate companies insurance.

THIS IS WHY I SAY, NEVER TRUST A GOVERNMENT AGENCY TO HELP YOU.

We would have been better off, if we never called the office of Commissioner Anne Head.

By the way, our calls and e-mails to the Office of the Commissioner are now met with STONEY SILENCE.

They got what they wanted from us.  Now, we are just trash to be disposed of.

This horror, we suffered, should NEVER happen to any citizen.

Also, such internet reviews are uphelf as Free Speech by the United States Supreme Court.

We are thankful for the Wisdom of the Justices of the Supreme Court.
