In 1995 I went on disability for cancer I was diagnosed with in 1992. That disease made it impossible for me to continue working as a civil engineer, and I am still battling recurrences of this disease.I have had nearly 100 surgeries to remove sweat glands under each arm and buttocks and both legs. It is extremely painful especially in the summer months.  I had a credit card acct. with Capital One and I called them and set up a payment plan to pay them off once I finally started getting SSI and they drafted my checking account each month and I was supposed to be able to resume my credit card acct I had with Capital One with the same line of credit, however after I made the last payment I got a card from another bank with a huge interest rate, and they said that Capital One sold them my account. I do not even recall the name of this bank as I cut the card in half and mailed all documents back to them. Now starting last week this APM company called me and they are reporting this to the credit bureaus as a new debt and they say I owe them $538.00 That was for a $250.00 fee to join the other card and the rest is interest and fees. They say they are collecting on behalf of Capital One though. I have not received any letters in the mail. I have a Bank Of America Platinum Credit Credit Card with a line of credit of $10,000.00 which I got in January 2009, I have a $1000.00 JC Penney Card with a $900.00 line of credit which I have had for 2 years, and I have a Household Bank Mastercard with a $2000.00 line of credit and a Chevron Texaco gas card with a $600.00 limit that I received last summer. If I was delinquent in a old card the Bank Ofd America would not have issued me a Platinum card with a line of credit of $10,000.00. All of these cards I have are unsecured. I got behind due to cancer, I underwent years of treatment and surgeries and recurrences and I stayed in contact with my creditors, and I paid them all. TRhese roque collection agencies buy old accounts that cannot be put in for collection or filed as delinquent if they are over 7 years old from what I have read, so they lie. I have no paperwork, it just seems to me that they will buy these acctys for almost nothing and say that they are new accounts and try to ruin my credit if I do not pay what I do not owe. I have read about these credit repair places that handle companies like these, but I have read they are also scams. I have no idea what to do. I have a small business and I deal in precious metals and rare gold and silver coins. I cannot afford to have my credit suddenly showing accounts that are unpaid that I do not owe. I will not even talk to these theives as they will twist anything you say. I have read about these fraudulent debt collectors but this is my first time dealing with them. They hide their phone number and I have no idea where they are located. I am not giving my checking acct. # to them over the phone like they asked before I realized what they were about. What should I do? Any advice would be greatly appreciated.

If you didn't sign up for the card, you shouldn't have to pay.

If sort of confused as to who is billing you. You said this collection agency is collecting on Capital One's behalf, even though you paid them off. Have you saved your documents showing you paid them off? It would be helpful if you do have this.

As far as the other bank goes, you don't owe them anything. A company cannot send you a credit card, and start charging you money. You have to go through the regular sign up stuff, and agree to terms and conditions. If they don't have your signature, they can't force you to pay. ( I think...)

Have you tried to call Capital One to see if they did sell your information....
Call the bank too since you sent back the card in pieces. Make sure this charge is from them, and some some scam artist who got your information and is trying to scare you into making payments.

If push comes to shove, threaten legal action. You didn't sign up for this card, you sent it back, and they are trying to charge you anyway. For someone who has cancer, stress is the last thing you need right now. You could probably sue them for something. Check with a good lawyer.
