I filed a claim with this company in August and 2 months later received a denial that states "a man walking up and down the curb of the street slipped and almost walked into the street causing our insured to swerve in order to avoid striking him, therefore, our insured is not the proximate cause of this loss."

Can you believe that, first of all, there was no one on the curb and their insured stated at the scene that it was the Little Caesars sign board person and I have a statement from the manager of Little Caesars stating that at no time do they ever have any employees located in the West side of the street.

This "person" would have to have been on the West side of the street for this to happen the way their insured says. Apparently as long as you swerve to avoid a pedestrian that wasn't there, you can hit whoever you want and get away with it. Wouldn't this fall under "Failure to avoid an accident?"

Shouldn't he have been traveling at a reasonable rate of speed so he could STOP in an instance such as this rather than swerving into another lane and hitting another vehicle. This company is awful and their employees are really rude and unhelpful. I do not know how these people sleep at night knowing full well they are cheating liars.
