I had my water tested and decided to go with a water softner from Aquativa in Lafayette. They also have a office 25 miles down the road in New Iberia. When the installed the unit they told me the electrician would come in a couple of weeks because he was out with a broken leg. That was May the 5th. It is not July 19th and I can not get them to return my calls. Jacob was suppose to come test my water again after I had my water softner to show me the difference the unit made. He did make 1 appointment with me but never showed up. Now after many calls and faxes they still do not honor their customer satisfaction.
They did not complete the job. I have already paid for the service that I did not receive.

It is not just the customer who has been wronged in this case, it is the real AQUAtiva company that had nothing to do with this transaction.

AQUAtiva is a product of Covenant Air & Water, LLC, based in Bradley, Illinois. AQUAtiva products are manufactured and distributed through a network of exclusive, authorized Dealers.

There is no authorized Dealer in the Broussard, Louisiana area. However, it came to our attention in 2003 and that one or more individuals in the Louisiana area were claiming to sell AQUAtiva products, but were in fact installing different equipment. Other instances included unauthorized use of Covenant's AQUAtiva trade name, claims by individuals that they bought this company and now own AQUAtiva, and other such nonsense. We have heard countless stories similar to this consumer's. These acts are NOT being committed by genuine AQUAtiva Dealers.

Covenant has worked hard for the past 3 years with the Better Business Bureaus in Louisiana, the Attorney General's office, and local law enforcement to identify these individuals and protect consumers from them.

In late 1993, Covenant filed suit against two of the parties who knowingly took part in the improper use of the AQUAtiva trade name. The federal court found in favor of Covenant Air & Water. Specifically, the Court found that Covenant has been harmed in several ways, including:

"Damages to its business reputation in the amount of $500,000 based on defendants' sale of 403 inferior, non-AQUAtiva water purification and refining systems to customers..." who had thought they were purchasing genuine AQUAtiva products from an Authorized AQUAtiva Dealer; and that

"Covenant incurred damages in the amount of $1,632,900.00 as a result of defendants' unauthorized display and use of Covenant's AQUAtiva trademark and trade name...advertisements in telephone books which incorporated the AQUAtiva trademark and trade name..." and other examples of fraud.

(Case No. 03 C 8558 filed in the United States District Court for the Northern District of Illinois Eastern Division.)

Covenant secured a Temporary Restraining Order in 2003 when it first became aware of such activities. Several persons/businesses violated that restraining order and continued the fraudulent behavior that, in part, resulted in the above judgment in Covenant's favor by a federal judge.

The parties failed to disclose the extent of their activities, of how many people they had involved throughout Louisiana and Mississippi in such activities, or to identify all of the victims of their fraud. Our company therefore has no way of ever knowing in advance who these people are.

I can tell you that in all probability, the customer who listed this complaint was NOT dealing with anyone who is an Authorized AQUAtiva Dealer. The AQUAtiva Dealer network is comprised of the best water professionals in the industry. They carry the finest product line with the best warranties in the industry.

Our strong recommendation to this consumer is to contact their local police department and file a "Theft by Fraud" complaint against the individual from whom they purchased the product they THOUGHT was an AQUAtiva system. Other consumers in the area have done the same, and local consumer protection officials in Louisiana have asked us to recommend such action to all consumers in Louisiana who have been similarly wronged. As a company, we are not able to file such a claim on behalf of a victim -- only the victim can file such a claim with the police.

Covenant and all of its AQUAtiva Dealers around the country want all of the wrongdoers in the area to be brought to justice. Toward that end, this company has spent hundreds of thousands of dollars trying to protect itself and the people of Louisiana. We will continue to do so.
