RE: David Parker/Kathy Marble
2014 Hyundai Sonata
To whom it may concern,
First of all, we at Arizona Premier Auto, LLC are both shocked and amazed at this erroneous complaint being filed against us. We have over 25 years’ experience in the automotive industry specializing in helping individuals that have less than perfect credit situations obtain financing and vehicles in order to help them re-establish their credit. Unfortunately, there are rare occasions, like this, where customers try to “push the envelope’ by providing documentation that is not credible.
Kathy Marble applied for a loan with us on August 12, 2016 via an internet loan application process. Based on the information she provided, we were able to secure a loan for her that same day. Because we are a dealership that genuinely cares about our customers, our sales consultant Tim Aberegg agreed to meet the customers at the dealership to help put them in dependable transportation on Sunday, August 14, 2016. We are normally closed on Sundays; however, in an effort to better accommodate our customers, we agreed to be there that day to help Kathy. She supplied us with the bank requested stipulations: Driver License, Paystubs, References, and Verification of Residence. Once the numbers were agreed upon, we delivered Kathy in the 2014 Hyundai Sonata.
We submitted the entire loan package to the lender via FedEx, which arrived at their physical location on Tuesday August 16th, 2016. The loan processors began their verification process, and came to the conclusion that the paystubs submitted were fraudulent. The lender stated, and I quote, “Paystub in file is unverifiable: FICA taxes are incorrect for current and year to date. FICA taxes are being based off 2 different gross amounts. We are unable to further consider.” Since the lender is a Federally Regulated lending institution, they wanted to press charges against Kathy. Arizona Premier Auto also reserved the right to file a police report against her and press charges of committing bank fraud. However, out of empathy for the customer, we decided to persuade the lender not to press charges. We contacted the customer to notify them of the situation, and she immediately became verbally combative over the phone. We told her if she had any information she could provide us to prove the paystubs were not fake, that we would be glad to try and continue to help her. Arizona Premier Auto even went one step further and agreed to allow her to continue to stay in the vehicle until the following Monday (August 22, 2016) to allow her time to find other driving arrangements.
It was agreed that we would go to her place of residence and pick up the vehicle on the morning of August 22, 2016. Our sales consultants Tim and Anthony both arrived at her home around 8:00 am. When they got there, the vehicle was there, but Kathy was not. They knocked on her door for over half an hour, and made numerous attempts to contact her on her phone, but had no success getting in touch with her. At that point, we determined that we needed to contact a repo company to pick up the vehicle for us in order to get our property back. The car was towed back to our facility at 9:24 am. It wasn’t until Tim attempted to contact her references that Kathy finally called us back and gave back the keys to the car. We incurred over $500 in repo fee’s, detail fee’s, and safety inspection fee’s just to get the car back to a state in which we felt comfortable selling it.
We at Arizona Premier Auto are blown away by the audacity of this customer to fraudulently obtain a vehicle from us, and then try to file an erroneous claim against our company after all that we tried to do to help her, and avoid pressing charges. This will not deter us from helping customers who are truly in need of reliable transportation and affordable financing.
