On 3/28/04 received a Past Due Balance notificaion from Arrow Fincial for $209.10. After several calls to get information, being treated extremely rude, finally found out that on August 1990 we made a purchase at Mervyns for $53.

We never received a bill from Mervyns and had not knowledge or recollection of any outstanding debt.

After 14 years and no notification during that time, we now owe $208.10.

I will go ahead and pay the Settlement Amount of $104.55. I do think this is unfair and unacceptable. Arrow Financial mentioned that they had sent us 10 letters during those 14 years, but we never received a letter. How can that be possible!

You owe nothing! Even if there really was a bad debt in 1990 (very unlikely) you STILL owe nothing! It is too old to collect now. The clear intent in the laws is that OLD DEBTS DROP DEAD. Once it is more than 7 years old it cannot damage your credit rating, and there are no legal processes that any company can use to force you to pay. They had many years to attempt to collect, and didn't.

If you do pay, you will be placed on a list of "people willing to pay garbage 'debts.'" Arrow and their ilk will not leave you alone, quite the contrary it will get worse. Do not talk to them on the phone any more. Send a "cease and desist" letter (see reports about CAMCO for examples).
