Upon closing of a refinance, Jessie Wycoff of Ascent Home Loans (an employee) informed me that he did not change the good faith estimate costs to reflect what we had agreed upon. He gave me a document that stated he had not changed the figures and would re-imburse me $2,598.00 which was the original estimate prior to negotiation. I insisted that this be in writing which Mr. Wycoff produced. Letter is on Ascent letterhead. At the time I thought Ascent would be cutting me a check.

Turns out that "he" Jessie Wycoff was pledging his own money. He would pay me from his commissions on January 30th. Had I been aware that the loan officer was pledging his own money, I would have refused the closing until the corrected figures were produced.

Mr. Wycoff is not disputing that he owes me the $2,598.00. He simply does not have the money to reimburse me. Today 3/12/07 I asked him why he could not get a cash advance on his credit cards? Seems he does not have any credit cards.

I have also contacted Chris Dozsios (an Ascent owner) on two occasions and explained each time the problem. Chris indicated that he will get with Mr. Wycoff and get this taken care of. I have many voice recording's from Mr. Wycoff which does not dispute my claim.

Of further concern is that everything you would want to know about me and my wife is in the hands of Mr. Wycoff. If he is not credit worthy and does not pay his obligations, what are my chances he will steal or sell my identity? That one fact alone alarms me more than the $2,598.00

I have the document Mr. Wycoff produced at closing. Additionally the loan closer from Security Title was present during the discussions of the overcharge.

In my opinion Ascent Home Loans is involved in some sort of scam. They are not stepping up to the plate and re-imbursing me. Basically they are ignoring me. The Denver BBB has contacted Ascent twice and no one from Ascent has responded.

I have read your rebuttal and find it interesting that you agree with me 100%. Your rebuttal is the first official written response I have seen. All my written or oral requests to your company have been completely ignored.

As you are well aware, the State has no jurisdiction in this matter. The event occured prior to the State being able to do anything. Events prior to July 1st, 2007 are not actionable by the State. Your comments regarding your efforts working with the State are disingenuous.

The "terminated" employee means that he was actually an employee at the time. Ascent had the ability to hold back any commissions going forward and refunded my money immediately. Mr. Wycoff was still an employee for many months after Ascent was aware of the problem.

I first called Mr.Roland Dozsios (CEO) to set up the loan. Mr Dozsios called me back and stated that he personally did not do these loans. Mr. Dozsios then "assigned" Mr. Wycoff to my account, stating that Mr. Wycoff was "his right hand man with these types of loans." Since Mr. Dozsios pushed me off on someone they eventually fired, why are they not responsible?

In my opinion, Ascent Home Loans is responsible regardless of whether or not Mr. Wycoff had the authority. How is a consumer to know that the person handling the loan does not have the authority to make guarantees? Am I supposed to also question his authority for refunds as well as his ability to originate the loan?

Ascent is doing absolutely nothing worthwhile correct this situation. They are not doing everything they can otherwise Ascent would step up to the plate and pay me. They had the ability to take commissions from Mr. Wycoff and refused. Mr. Wycoff stated to me in September 2007 that his commissions were held back from his final check for my reimbursement. If true, where is my refund?

At the end of the day, Ascent has not refuned the $2,598.00 to their customer with which they "agree 100%." Instead they have only now responded to an event 1 year old.

$2,598.00 is not a great deal of money to a credible, ethical company. To repair their reputation it would seem to be money well spent. Ascent's refusal to correct the situation appears to me as their "standard operating procedure."

We are aware of this situation and side with the Borrower 100%. The Loan Officer in question did not have the authority to act on Ascent Home Loans behalf in regards to his arrangement with the Borrower. As a result, we terminated this Loan Officer, and are currently working with the State of Colorado in a full investigation of all business conducted by said Loan Officer.

We do not conduct business this way, nor do we take it lightly when a Loan Officer decides to violate their employment agreement, and conduct business in this manner.

We are still actively working to see that the Loan Officer in question is held responsible for his actions. At this point in time it has been elevated to a State level.
