ASF International The organization continues to bill be for membship dues despite a faxed and hand delivered membership letter delivered to client (Fierce Fitness, Inc.) in 2008 Highlands Ranch,, Colorado
This organization is unethical in its
business practices. In 2008 I faxed a letter to the facility cancelling my
membership. I called to confirm receipt of the faxed letter only to be told it
was never received despite confirming the fax number and receiving several fax
confirmations the transmission of the document was successful. Therefore I
walked in the letter in sealed envelope and delivered it the person at the
front counter to be delivered to whomever handles their memberships.
Now 3 years later I find that they had never cancelled my account were auto
debiting my bank account since 2008. I noticed the debit when reviewing my bank
statement for another unauthorized charge on account I rarely use but maintain
a balance in the account for miscellaneous expenses. I immediately contacted my
bank to stop payment on the debit and reverse it. I have since received a
letter from the account receiveable agent (AFS International) seeking to bill
me for the monthly previous month membership dues resulting from the stop
payment as well current dues. I wrote both ANOTHER letter to Fierce Fitness and
AFS International, this time via Certified Mail and email along with the copy
of the 2008 cancellation letter demanding the reimbursement of debited funds
since 2008 and the cancellation of membership. AFS responded thus far
indicating they will not cancel my membership until I pay them membership dues
for both February and March. This is despite both my 2008 letter and current
letter demanding my membership be cancelled retroactive March 2008 and the
reimbursement of debited funds since March 2008.
It is clear this organization received my faxed request in 2008, which was
followed by a hand delivered letter, but for whatever reason do not want to
cancel my membership. My membership was month to month, not long term contract
obligating beyond month to month. I have heard about abuses of by this
organization as it relates to their auto-debit billing as it relates to duplicate
billing and other errors within their accounts receivable and billing system.
If I am not reimbursed for dues debited since 2008, I will seek legal action
for remedy.

The client (Fierce Fitness) is lying about receiving the cancellation letter. They played games when I faxed the cancellation letter in 2008 claiming to never have received it despite me receiving several fax confirmations the document transmitted successfully. Because of these games on their part claiming to not have received the faxed copy, I walked in a copy of the letter in a sealed envelope addressed to "Attn: A/R Manager" and hand delivered it to the lady at the front desk whom assured me it would be delivered to the appropriate party within the organization.
Now what's ironic is the numerous complaints on this complaint board and others describing almost the identical scenarios that's happening to me is happening to others as it relates to illegal and unthecial billing practices of ASF. If this problem is resolved at this level, will be to file a complaint with the Federal Trade Commission to launch an investigation on this organization (ASF) and Fierce Fitness. I am sure based on the number of complaints relative to this subject they will find a pattern of wrongdoing which hopefully result in stiff fines and penalties to these organizations.

No cancel letter received

We checked with our client regarding this complaint and they have informed us that request to cancel was never received. Also, I find it somewhat curious that somebody would make the claim they canceled a membership but continue to allow monthly deductions for that membership go on for 3 more years.
