Complaint Review: Aspire Visa

I have been involved with a credit counseling agency for over a year now and Providian/ Aspire Visa was the only one not to accept right away. Then they did accept the proposal sent by the cc counceling agency. Then I got a card in the mail saying that my account was going to be an Aspire visa instead of a Providian Account. Ever since then I have recieved only two invoices in the mail. This has been in the last 9-12 months. What kind of company only sends you a bill when you have to tell them to, or when they get around to it. I now have been getting phone calls from them again asking for their payment when we already have set up a payment schedule. The balance on my card went from 1700 to 2500 in a weeks time. How could that be? I must be getting charged some awfully high interest and late payment fees, but I really wouldn't know that since I haven't recieved a bill in over four months.

If anybody can help me in stopping them from calling me all the time everyday even after repeated statements by me as well as my wife telling them to never call us again. We tape record all of the calls made to us by these crooks. The lady that called me today tried to withold the 800 # from me when I started to ask her questions about where she worked, who she worked for, and so on. She kept telling me that they would call me every single day.

These are her exact words to me "What, you think that because you tell me not to call you, you think that is going to stop us from calling you? There is nothing that will stop us from calling you EVERY DAY. And they have been calling every day. I work nights and sleep in the mornings, and that is when they call me. They will call me 3 times in 15 minutes even if they were the ones who hung up on me, which happens most of the time. They even refused to speak with me anymore because I was abusive to them, demanding to speak with my wife instead. That is just plain funny. Me abusive to them. Can anyone help me out on this? How do I stop them from calling me, and how can I sue there butts?

I had this same type of problem with a different collection agency. You need to look on the internet to find a site that has guidelines to help you stop them from harrassing you. Look under fair debt collections. Most all will tell you to write them a letter telling them to stop contacting you at home and at work.

Send it certified, return receipt and keep a copy. If after they receive the letter from you and they continue to call and harass you, YOU can sue them for about a thousand dollars each time they violate the cease and desist letter.

Check out the web sites for Fair Debt Collections. They are invaluable to all consumers. If everyone were well informed these slime that lie and harass us will behave or they would be paying out in court.

Kevin,It is my understand that certain guidelines were set down for any company trying to collect a debt, IE: that they are not allow to call you all the time, like making phone call after phone call or calling during cerain hours. To call 3 times in 15 min is clearly a violation of the guidlines. I live in Tx so I don't know if these guidelines apply to your state too. Check it out and if they are in violation of these guidelines they can be sued.
